Proposing to legislate and stipulate mandatory principles on standards and regulations for highways, National Assembly Member Le Hoang Anh (Gia Lai) said that it is necessary to stipulate that highways must have hard median strips. , emergency lane, parking stop; At the same time, regulations on the minimum gauge of highways are 3,75m, to avoid the risk of narrowing the gauge to save costs when making phased investments. In addition, according to delegates, the speed of vehicles moving on the highway must be the highest in the system of technical levels. The speed at which vehicles move at each stage will be regulated by the Ministry of Transport.
Divergent expressway clearance once or many times?
Regarding compensation, support, and resettlement of the highway (site clearance), delegate Nguyen Ngoc Son agreed with the draft Law submitted by the Government. Accordingly, compensation, support and resettlement work is carried out according to the planned scale instead of phasing, because the budget for this work is only about less than 20% of the total investment cost. However, it is necessary to clarify the use of land that has been cleared but has not yet been invested in because if it has been cleared but managed ineffectively, it will be costly to handle later.
National Assembly Member Pham Van Hoa (Dong Thap) said that in the current economic conditions, when building and developing highways, it is necessary to consider the long term. If the land is not cleared according to planning, it must continue to expand in the future. There will be many difficulties in implementing site clearance, while the implementation costs according to the analysis submitted by the Government account for about 15 - 20% of the total investment cost.
According to National Assembly Member Tran Van Lam (Bac Giang), highway investment must calculate economic efficiency. If the site is cleared and then left there, it will be wasteful. “The fear of people living in neighboring areas encroaching on planned construction, and the responsibility for managing planning belongs to local governments. With poor management, even after liberation, people will still encroach," said delegate Tran Van Lam.
Decentralize the Provincial People's Committee to invest in the construction of national highways
Regarding the regulations assigning the Provincial People's Committee to invest in the construction of national highways in Article 32, expressways belonging to the national highway system in Article 47 and manage, operate, exploit and maintain national highways in Article 39, based on the opinion The direction of the National Assembly Standing Committee and the Standing Committee of National Defense and Security to receive and revise Clause 2, Article 28 of the draft Law follows the direction: in case of decentralization to the Provincial People's Committee to invest in the construction of national highways, it must be in accordance with the provisions of the State Budget Law, Public Investment Law and relevant laws.
Regarding the management, operation, exploitation and maintenance of national highways, the Standing Committee of National Defense and Security added Point c, Clause 2, Article 37 in the direction of: transferring the national highway section to the Provincial People's Committee for management. according to the provisions of the Law on Management and Use of Public Assets.
Agreeing with this content, delegate Nguyen Ngoc Son said that decentralizing the provincial People's Committee to invest in building national highways according to Clause 2, Article 28 will help take advantage of investment resources to develop a synchronous system, meeting Meet the transportation needs in many localities today. But, because the current State Budget Law and Public Investment Law have not yet decentralized this construction investment to the Provincial People's Committee, the delegates suggested that it is necessary to regulate this content in the direction of decentralizing authority to the Provincial People's Committee. province at the request of the Provincial People's Committee and in accordance with relevant legal regulations.
