According to the Directive, in the past years, the state management of land in the province has made many positive changes, the management of land use has become more and more effective, efficient, gradually put into order, significantly contributing to the cause of construction and socio-economic development and ensuring security and defense.
However, the current reality is that there are still a number of cases where the works and projects have had a decision to allocate or lease land but have not or been slow to put the land into use but have not been promptly reviewed, inspected and handled according to the provisions of the law, causing land waste and frustration among the people.
In order to rectify the land management in the province and overcome the above situation, the People's Committee of Thai Binh province requested the Department of Natural Resources and Environment to assume the prime responsibility for, and coordinate with the Department of Planning and Investment, the Management Board of Economic Zones and Industrial Parks in the province, the Department of Construction, the Provincial Department of Taxation, the People's Committees of districts and cities to review, compile a list and management records for organizations that have been allocated land or leased land for 12 consecutive months without continuing to use land or lease land for 24 consecutive months. regulations; synthesize difficulties and problems, evaluate causes (objective and subjective) of investment projects' failure or delay to put land into use.
At the same time, organize the inspection and examination of all projects and works that do not put land into use or are behind schedule of land use; strictly, thoroughly and lawfully handle works and projects with violations; resolutely recover land for works and projects that have terminated investment projects, have expired the time limit for land use extension but have not yet completed the investment and put the land into use.
In addition, synthesize and make a list of projects and works with violations to post publicly on the portal of the Provincial People's Committee and send information for public posting on the portal of the Ministry of Natural Resources and Environment before November 30 every year.
The Provincial People's Committee also requested the Department of Planning and Investment, the Management Board of Economic Zones and Industrial Parks of the province to adjust the project investment progress to ensure compliance with the provisions of law, to make a list and synthesize difficulties and obstacles, to assess the causes (objective and subjective) of the projects behind the investment schedule; advise and report to the Provincial People's Committee solutions to remove difficulties and obstacles so that investment projects can be implemented on schedule; limit the extension of investment progress.
Besides, inspect, supervise and evaluate investment projects according to their assigned functions and tasks; advise the Provincial People's Committee to terminate the operation of investment projects for projects with violations in accordance with the provisions of the investment law.
According to the Directive, the People's Committee of Thai Binh province requested the provincial Tax Department to urge and fully apply measures to handle coercive enforcement of tax administrative decisions for projects that do not or are slow to fulfill financial obligations on land as prescribed; promptly provide information, a list of projects that fail or are late in fulfilling their financial obligations on land, and send it to the Department of Planning and Investment and the Department of Natural Resources and Environment to coordinate in advising on handling measures in accordance with law.
The Department of Construction is responsible for guiding the People's Committees of districts and communes to strictly implement the Decision No. 13/2022/QD-UBND of the Provincial People's Committee promulgating the Regulation on coordination in inspecting and handling violations of construction order in Thai Binh province; inspect, examine and strictly, promptly and completely handle violations of construction order in the province.
Relevant departments, branches and units, according to their assigned functions and tasks, are responsible for closely coordinating with the district-level People's Committees to implement measures to strengthen land management in accordance with law.
People's Committees of districts and cities strengthen land management in the area; regularly review, inspect and monitor the land use progress of projects in the area, promptly detect projects that are behind the investment schedule, fail to implement the project, report to the Provincial People's Committee (via the Department of Natural Resources and Environment) for handling in accordance with the law.
