On May 22, the High People's Court in Hanoi opened a trial to consider the appeal of Ms. Nguyen Thi Thanh Nhan (former Chairman of AIC Company) and 5 other defendants in the case that happened at AIC Company, General Hospital. Dong Nai and related units.
The jury consists of 3 judges, chaired by Mr. Mai Anh Tai.
Among the defendants who appealed, in addition to Ms. Nhan (who was replaced by an appeal lawyer), there were also two former deputy general directors of AIC Tran Manh Ha and Hoang Thi Thuy Nga, former director of Dong Nai General Hospital Phan Huy Anh. Vu. Among these, Nguyen Thi Thanh Nhan and Tran Manh Ha and 2 other defendants are wanted.
The civil defendant of the appeal case is Progressive International Corporation (AIC). Mr. Tran Dinh Thanh (former Secretary of Dong Nai Provincial Party Committee) and Mr. Dinh Quoc Thai (former Chairman of Dong Nai Provincial People's Committee) did not appeal, but accepted the first-instance punishment.
In the sentencing section on January 4, the Hanoi People's Court said that defendant Nguyen Thi Thanh Nhan had contacted Dong Nai leaders to ask for help, for AIC Company to participate and win the bid at Dong Nai General Hospital. even though they know they don't have the financial capacity to participate.
Ms. Nhan then directed the staff to collude with the investor and units to prepare bid documents in the direction of helping AIC Company win the bid. Through this, AIC participated and won 16 bidding packages at Dong Nai General Hospital, causing a loss of 152 billion VND.
Working in Dong Nai, defendant Nhan and his subordinates bribed the then Secretary of Dong Nai, Mr. Tran Dinh Thanh, 14,5 billion VND; Dinh Quoc Thai VND 14,5 billion and Phan Huy Anh Vu VND 14,8 billion. Defendant Bo Ngoc Thu was also "thanked" for 1 billion VND.
The court determined that defendant Nhan had committed the crimes of giving bribes and violating bidding with the role of leader, mastermind, and was subject to the aggravating circumstance of fleeing.
Former employees at AIC testified to follow the highest direction of Nguyen Thi Thanh Nhan. Former Deputy General Director Hoang Thi Thuy Nga claimed that Nhan was authorized to carry out the bidding process at the project, contact provincial leaders, direct subordinates and connect with the "green army".
With the above conclusions, the trial panel sentenced Mr. Thanh to 11 years in prison, and Mr. Thai to 9 years in prison, both for the crime of accepting bribes. Nguyen Thi Thanh Nhan was sentenced to a total of 30 years in prison. Mr. Vu received a total sentence of 19 years in prison. Ms. Hoang Thi Thuy Nga received 12 years in prison for violating regulations on bidding, causing serious consequences. The remaining 29 defendants received sentences ranging from 30 months of probation to 6 years and 6 months in prison.
