The Ministry of Education and Training requests a report.

The Ministry of Education and Training has recently issued a document responding to inquiries regarding the organization and operation of Kinh Bac University, located in Bac Ninh City, Bac Ninh Province.

The Ministry of Education and Training stated that it has received letters from Ms. Nguyen Thi Tuyet Hong, Mr. Doan Xuan Tiep, and other related individuals and organizations, reflecting on and making recommendations regarding the organization and operation of Kinh Bac University.

In fulfilling its responsibility for state management of education , the Ministry of Education and Training has worked with relevant parties to verify information regarding the organization and operation of Kinh Bac University. Based on reports and supporting documents provided by relevant parties up to October 16, 2024, the Ministry has issued several opinions.

The dismissal of Mr. Doan Xuan Tiep from the position of Chairman of the University Council, the dismissal of Ms. Nguyen Thi Tuyet Hong from the position of Vice Chairman of the University Council, the recognition of Ms. Nguyen Thi Tuyet Hong as Chairman of the University Council, and the addition and replacement of other members of the University Council of Kinh Bac University from December 2023 to the present did not comply with the procedures stipulated in Article 8 of Government Decree No. 99/2019/ND-CP dated December 30, 2019, detailing and guiding the implementation of some articles of the Law amending and supplementing some articles of the Law on Higher Education, and the Regulations on the organization and operation of Kinh Bac University issued together with Decision No. 03/QD-HDT dated August 15, 2020, of the University Council of Kinh Bac University.

The dismissal of Mr. Nguyen Van Hoa from the position of Rector of Kinh Bac University and the assignment of Ms. Dao Thi Bich Thuy to be in charge of and manage all activities of Kinh Bac University did not comply with the procedures stipulated in Article 16a of the 2012 Law on Higher Education (amended and supplemented in 2018), Clause 5, Article 8 of Decree No. 99/2019/ND-CP, and the Regulations on Organization and Operation of Kinh Bac University issued with Decision No. 03/QD-HDT dated August 15, 2020, by the University Council of Kinh Bac University.

The Ministry of Education and Training requests the investor, the school board, and the Rector of Kinh Bac University to review, self-inspect, amend, supplement, replace, revoke, and abolish any documents that were issued improperly, without proper authority, and in violation of regulations on personnel standards as prescribed by law.

The Ministry requires appointed and assigned individuals not to perform duties in accordance with appointment or assignment decisions that violate the law. Relevant collectives and individuals are legally responsible for any actions or powers taken contrary to the law that affect the legitimate rights and interests of students and related organizations and individuals as stipulated by law; for issuing regulations on organization and operation; for carrying out procedures for establishing and recognizing the school council; for recognizing, dismissing, and removing the chairman of the school council and adding or replacing other members of the school council; for recognizing, dismissing, and removing the Rector of Kinh Bac University in accordance with the Law on Higher Education 2012 (amended and supplemented in 2018), Decree No. 99/2019/ND-CP, and other relevant legal documents.

Regarding matters not within the scope of state management of the Ministry of Education and Training (such as financial disputes, property issues, investments, capital contributions, use of seals, labor relations, etc., at Kinh Bac University), organizations and individuals are requested to submit proposals and recommendations to the competent authorities for resolution in accordance with the law.

The fact that Kinh Bac University has not complied with the law regarding its organization and operation is the responsibility of the investors and the University Council. Therefore, the Ministry of Education and Training requests that the investors and the University Council of Kinh Bac University urgently take measures to stabilize its organization and operation, and to reorganize its structure and personnel in accordance with the law.

The Ministry of Education and Training requires Kinh Bac University to submit a written report, along with supporting evidence, on the implementation of the above-mentioned contents to the Ministry before November 15, 2024.
