Commune/ward level issues land ownership certificates ("red books").

Over the years, the process of obtaining land use rights certificates has always received considerable attention from the public. This is because the procedures in this area are often complex and difficult, requiring people to travel multiple times and to various levels and locations to complete the necessary paperwork. Fortunately, upon implementing the two-tiered local government model, the Government issued a decree stipulating the decentralization and delegation of authority to communes, wards, and special administrative regions to issue land use rights certificates. This decree has received widespread support and approval from the public and the media.

In implementing Government Decree 151/2025/ND-CP, the Ministry of Agriculture and Environment issued Decision 2304/QD-BNNMT dated June 23, 2025, on the announcement of land administrative procedures within the scope of state management functions of the Ministry of Agriculture and Environment.

Accordingly, there are 6 procedures related to "land ownership certificates" implemented by the commune level, including: Re-determining the residential land area of ​​households and individuals that were granted certificates before July 1, 2004; Correcting errors in initially issued certificates; Revoking certificates issued incorrectly according to land law regulations when discovered by land users or owners of assets attached to the land, and re-issuing certificates after revocation; Registering land and assets attached to the land, and issuing certificates of land use rights and ownership of assets attached to the land for the first time for organizations currently using the land; Registering land and assets attached to the land, and issuing certificates of land use rights and ownership of assets attached to the land for the first time for individuals, residential communities, households, and people of Vietnamese origin residing abroad; Registration and issuance of land use rights certificates and certificates of ownership of assets attached to land in cases of gifting land use rights to the State or the community, or for road expansion.

The procedures have also been significantly streamlined. Citizens prepare their documents according to the prescribed form and submit them directly to the designated receiving location or through the public service portal. After receiving the documents, land administration officials conduct on-site inspections, compare the documents, and determine the current land use status. Notably, the requirement for a "no disputes" confirmation certificate is no longer required, as the responsibility for verification and post-inspection rests with the local government. If all conditions are met, the Chairman of the People's Committee at the commune level signs and issues the land title certificate within a maximum of 3 working days from the completion of financial obligations. The total processing time for initial land registration applications is limited to 17 working days, a significant reduction compared to the old process.

It can be said that the changes in the issuance of land ownership certificates are expected to help people in localities shorten procedures, save time and costs, and increase transparency. From the perspective of local authorities, land management will be more practical and effective. This policy is consistent with the two-tiered local government model and aligns with the wishes of the people.
