What is the maximum penalty for speeding in cars and motorcycles?

According to the latest Road Traffic Law, the maximum penalty for drivers of cars and motorcycles exceeding the speed limit is a fine of up to 12 million VND and suspension of their driver's license for up to 4 months.

Specifically, driving a car or motorcycle at speeds exceeding the legal limit is strictly prohibited under Clause 11, Article 8 of the 2008 Road Traffic Law, and violations will be punished according to regulations.

According to Decree 100/2019/ND-CP (amended by Decree 123/2021/ND-CP), the penalties for driving a motor vehicle at excessive speed are stipulated as follows.

Penalties for speeding in cars.

A fine of VND 800,000 to VND 1,000,000 will be imposed on drivers exceeding the speed limit by 5km/h to less than 10km/h (applied under Point a, Clause 3, Article 5 of Decree 100/2019/NĐ-CP).

A fine of 4 to 6 million VND will be imposed on drivers exceeding the speed limit by 10 to 20 km/h (applied under Point I, Clause 5, Article 5 of Decree 100/2019/ND-CP, as amended by Point d, Clause 34, Article 2 of Decree 123/2021/ND-CP).

For this violation, the driver will also have their driver's license suspended for 1-3 months (Point b, Clause 11, Article 5 of Decree 100/2019/ND-CP).

A particularly serious traffic accident occurred in Nui Thanh, Quang Nam, due to the driver exceeding the speed limit.

A fine of 6-8 million VND will be imposed on drivers exceeding the speed limit by 20km/h to 35km/h (Point a, Clause 6, Article 5 of Decree 100/2019/ND-CP).

For this offense, the driver will also have their driver's license suspended for 2-4 months (Point c, Clause 11, Article 5 of Decree 100/2019/ND-CP).

A fine of 10-12 million VND will be imposed on drivers exceeding the speed limit by more than 35km/h, the highest penalty within the administrative penalty framework (Point c, Clause 7, Article 5 of Decree 100/2019/NĐ-CP).

Specifically, for this violation, the driver will also have their driver's license suspended for 2-4 months (Point c, Clause 11, Article 5 of Decree 100/2019/ND-CP).

Penalties for speeding on motorcycles.

A fine of 300,000 to 400,000 VND will be imposed on drivers exceeding the speed limit by 5km/h to less than 10km/h (Point c, Clause 2, Article 6 of Decree 100/2019/ND-CP (amended by point k, clause 34, Article 2 of Decree 123/2021/ND-CP)).

A fine of 800,000 to 1,000,000 VND will be imposed on drivers exceeding the speed limit by 10km/h to 20km/h (Point a, Clause 4, Article 6 of Decree 100/2019/ND-CP (amended by point g, clause 34, Article 2 of Decree 123/2021/ND-CP)).

A fine of 4-5 million VND will be imposed on drivers exceeding the speed limit by more than 20km/h (Point a, Clause 7, Article 6 of Decree 100/2019/ND-CP).

In addition, the driver who commits the violation will have their driver's license suspended for 2-4 months (Point c, Clause 10, Article 6 of Decree 100/2019/ND-CP).
