Along with rapid urbanization, the demand for the construction of technical and social infrastructure projects is increasing. Annually, total social investment in construction accounts for approximately 30% of GDP. Overall, the quality of construction projects is constantly improving.

The completed projects have proven effective in operation, creating a new look for the country and representing a proud achievement of the national reform process. However, there are still projects of poor quality that do not meet the acceptance criteria, or projects under construction or that have experienced incidents shortly after being put into operation, causing serious damage to people and property.

It can be affirmed that the quality of construction projects is directly related to national development, the rapid, healthy, and sustainable development of the country's economy , and the safety of people's lives and property. Based on the objective laws of the market economy, to ensure the quality of construction projects and public safety, protect lives and property, and guarantee sustainable national development... therefore, the capacity for supervision and management of construction investment activities occupies a paramount position.

According to urban planning expert, Master of Architecture Tran Tuan Anh, the construction industry currently has great potential for development. Firstly, the rapid pace of urbanization has led to a surge in demand for housing and infrastructure (housing, commercial centers, transportation, industrial zones, tourist areas, satellite cities, etc.), along with the need to renovate and upgrade existing infrastructure. Meanwhile, the trend towards green construction and sustainable development presents opportunities for the construction industry to apply and develop new, environmentally friendly technologies and methods.

However, the construction industry is facing many challenges: economic recession affecting the industry's growth rate; a shortage of high-quality human resources for construction and management leading to substandard project quality; weaknesses in licensing and construction planning; obstacles and inadequacies in the legal regulatory system causing delays and increased investment costs; and the capacity of infrastructure to meet the demands of socio-economic development also posing challenges for the construction industry.

“The most important issue right now is the need to quickly finalize the policy system to create favorable conditions and maximize the capacity of the construction industry, contributing even more to socio-economic development; the State needs to focus on investing in technology research to apply to the implementation and management of the construction industry; focus on training high-quality human resources to improve work efficiency, project quality and State management. At the same time, it is necessary to tighten sanctions for violations in construction activities for individuals, organizations and officials performing their duties,” said Mr. Tran Tuan Anh.

Flexibly apply solutions

Currently, many countries around the world have very strict construction management systems, which significantly contribute to ensuring the quality of construction projects and preventing construction violations. For example, China has established a construction quality management system since the 1980s; the state issues standards and regulations on design, construction, and quality certification for construction units, requiring all projects to comply with them. Projects can only be used after all acceptance procedures have been completed; and the person in charge of the supervision unit cannot hold other positions in government agencies.

Similarly, in Singapore, construction projects must meet requirements regarding building planning, safety, fire prevention, traffic, and the environment before being approved by the construction regulatory authority. Furthermore, supervisors operate independently, not affiliated with any agency or organization; their work is based on honor, reputation, and experience.

For example, in Japan, a comprehensive system of legal regulations has been established to strictly govern the management of construction investment activities. This system includes numerous laws, all closely coordinated and consistent, such as the Law on Promoting Bidding and Formal Contracts for Public Works, the Law on Public Finance, and the Law on Promoting Quality Assurance in Public Works. Technical standards for inspection are compiled by regional development bureaus, while the inspection content in the supervision process is directly carried out by government officials.

According to Master Ninh Viet Dinh – Arbitrator at the Vietnam International Arbitration Center (VIAC), in addition to the achievements in recent times regarding state management of investment and construction activities, many limitations still exist, causing losses and waste of investment capital from the state budget. Many legal documents overlap and contradict each other, with localized content; there is no system of professional guidance, while the national database system lacks uniformity and scientific rigor...

 

Construction investment is a crucial driving force for socio-economic development, and state management of construction activities aims to carry out these tasks most effectively with available resources in the shortest time, thereby stimulating production, reducing unemployment, and improving the quality of life for the people. Therefore, in its role of guiding the market, the State needs to promote the capacity of participating entities in a healthy, transparent, and fair manner, creating a favorable environment for construction investment activities to strictly comply with the law.

“Currently, Vietnam is undergoing a process of deep integration with the international community. Therefore, ensuring compliance with international practices is crucial. Referring to international experiences and drawing lessons from them is essential. However, the quality of ‘localization’ of international documents and management models remains low. Therefore, we need to be more flexible in applying international solutions and experiences in managing construction investment activities,” said Master Ninh Viet Dinh.

Regarding solutions to address violations in construction activities, urban planning expert Tran Tuan Anh suggested that the State should consider and further promote the decentralization of power to local authorities down to the commune level (following the model of the Urban Construction Management Team in Hanoi); simultaneously perfecting legal regulations related to administrative handling of construction violations...

“The State needs to research, supplement, and provide specific guidance on standards and regulations in construction activities; overcome overlapping, conflicting, and inconsistent legal documents; and strengthen the dissemination of legal knowledge related to construction. At the same time, there needs to be closer coordination between law enforcement agencies in the State management of construction; but most importantly, it is necessary to prevent corruption through stricter sanctions to eliminate the ‘request-and-grant’ mechanism that leads to violations,” said Mr. Tran Tuan Anh.
