Combating smuggling and counterfeit goods:

"Local authorities must build effective coordination mechanisms between the central and local levels, and between different forces, in the fight against smuggling and counterfeit goods." This was the directive of Deputy Prime Minister and Head of the National Steering Committee 389, Bui Thanh Son, at the quarterly review meeting for the first quarter of 2025 and the implementation of tasks for the coming period of the National Steering Committee 389, on the afternoon of April 21.

Crimes and violations related to the production and sale of counterfeit goods, goods infringing intellectual property rights, goods violating labeling regulations, trading in expired or unidentifiable goods, trading in smuggled goods, and goods without invoices or documentation continue to occur in most key areas of provinces and cities.

The exploitation of e-commerce, online shopping on social media, express delivery, postal services , etc., for the production, trading, and transportation of goods of unknown origin, counterfeit goods, substandard goods, and goods infringing intellectual property rights is on the rise.

Regarding the methods used to evade law enforcement in transporting and distributing smuggled and counterfeit goods, Le Thanh Hai, Chief of the Office of the National Steering Committee 389, stated that smugglers, taking advantage of simplified procedures for transit goods, tax exemptions for temporarily imported and re-exported goods, and bonded warehouse storage, have mixed infringing goods with legitimate imported goods, infiltrating the Vietnamese market for consumption or falsifying their origin to export to a third country.

"Along the Vietnam-China border, smuggling activities involving firecrackers, alcohol, tobacco raw materials, medicinal herbs, foreign currency, and frozen food have become prevalent," Mr. Hai reported.

In the first quarter, units and localities seized and handled 30,651 cases of violations related to the trading and transportation of prohibited goods, smuggled goods, and intellectual property infringements; collecting over 4,616.7 billion VND for the state budget.

In Hanoi alone, 5,503 cases of smuggling, trade fraud, and counterfeit goods were handled, recovering more than 1,273 billion VND for the state budget.

Representatives from the Department of Criminal Investigation of Corruption, Economic Crimes , and Smuggling added that perpetrators often exploit express delivery services and the lax import and export regulations to smuggle and illegally transport easily transportable, high-value goods such as foreign currency, gold, diamonds, cigarettes, pharmaceuticals, cosmetics, and dietary supplements.

To evade law enforcement, smugglers often stockpile goods in private homes or vacant apartments in high-rise buildings, making inspection and control difficult.

The overlapping in management needs to be resolved.

Forecasts indicate that smuggling, trade fraud, and the transportation of goods falsely claiming Vietnamese origin for export to third countries will increase in the second quarter of 2025. Therefore, delegates recommended the early completion of regulations and legal frameworks.

Authorities are strengthening inter-agency coordination to combat smuggling, prohibited goods, and counterfeit goods at border checkpoints, international railway stations, and international airports; preventing crime right at the border crossings.

From a local perspective, Vice Chairman of the Hanoi People's Committee Nguyen Manh Quyen requested the National Steering Committee 389 to promptly issue guidelines on consolidating the Steering Committee 389 at the provincial and city levels, in accordance with the administrative unit restructuring, ensuring interconnectedness and uniformity.

At the same time, central ministries and agencies continue to advise the Government on perfecting the legal framework for e-commerce and business on digital platforms to improve the effectiveness of control, combat fraud, and prevent revenue losses.

Following recommendations from localities and functional forces, Deputy Prime Minister Bui Thanh Son requested the National Steering Committee 389 to develop a comprehensive plan of tasks and clearly define the responsibilities of each unit and force.

To contribute to market stabilization, the Steering Committee 389 of ministries, sectors, and localities needs to propose appropriate solutions to effectively combat and prevent smuggling, trade fraud, and counterfeit goods within their respective areas of responsibility and management.

In particular, localities and functional forces need to strengthen the exchange and sharing of information, and coordinate the monitoring of transshipment, temporary import, re-export, conditionally traded goods, and goods with high tax rates…

The Ministry of Justice, in coordination with other ministries and agencies, is reviewing regulations and sanctions to amend them to suit the current reality. At the same time, localities need to urgently strengthen the Steering Committee 389, and build an effective coordination mechanism between the central and local levels, as well as between functional forces, in the fight against smuggling and counterfeit goods.
