The Ministry of Interior has issued guidelines on new standards for commune-level civil servants, requiring objective and standardized personnel placement to improve the efficiency of services provided to citizens and businesses.

Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Government Steering Committee on the reorganization of administrative units at all levels and the construction of a two-tiered local government organizational model, has just signed and issued Official Document No. 11/CV-BCĐ.

This document provides specific guidance on the new standards for commune-level civil servant positions and outlines the personnel arrangement and placement during the streamlining and merger of administrative units, aiming to ensure a qualified and capable workforce capable of effectively carrying out the local political tasks.

The three core principles emphasized are:

1. Adhere closely to the directives of the Central Committee.

2. Conduct a thorough review of the current team to ensure appropriate job placement.

3. Link organizational reforms with improving the quality of public service.

For commune-level officials (Party Committee Secretary and Deputy Secretary; Chairman of the People's Council and People's Committee; Deputy Chairman of the People's Council and People's Committee): Follow the conclusions and guidelines of the Politburo , the Secretariat, and the Central Organization Committee regarding personnel plans when reorganizing the organizational structure and administrative units.

For commune-level civil servants (including: civil servants holding the positions of Head of Department and equivalent, Deputy Head of Department and equivalent, and professional and technical civil servants), they must meet general standards regarding political ideology and moral character, and educational qualifications.

In addition to meeting the general standards above, leading and managerial officials (Heads of Departments and equivalents, Deputy Heads of Departments and equivalents under the People's Council and People's Committee at the commune level) must also meet specific standards regarding political theory.

In cases where individuals are in the process of completing the political theory standards as stipulated in Decree 29/2024/ND-CP or Decree 33/2023/ND-CP, they may be considered as meeting the political theory qualification standards for appointment.

According to the Steering Committee's guidelines, commune-level officials and civil servants who are elected or recruited and whose salaries are determined based on their educational qualifications as stipulated in Decree No. 33/2023/ND-CP, if they meet the general standards and conditions as prescribed above, will be assigned to civil servant positions at the new commune level and classified as administrative civil servants at their current salary grade and coefficient, without having to go through the procedure of being officially appointed as civil servants.

In cases where commune-level officials and civil servants are being sent by competent authorities to pursue university-level training to meet the requirements of their assigned positions, the civil servant management agency shall consider and assign them to a suitable new position at the commune level; and they shall continue their training until graduation in accordance with regulations.

For commune-level civil servants who are ethnic minorities or work in areas with particularly difficult socio-economic conditions and have not yet attained a university degree, their competence, credibility, and practical experience should be considered when assigning them to suitable jobs; at the same time, their university degree must be standardized within 5 years from the establishment of the new commune-level administrative unit.

The Government Steering Committee also noted several other points. Specifically, the reassignment of provincial and district-level officials to work as civil servants at the new commune level, according to the approved restructuring plan, does not require the procedure for recruitment into civil service positions.

Officials and civil servants at the provincial, district, and commune levels who are currently assigned to work as civil servants at the new commune level will continue to receive their current salaries, grades, and allowances for a period of 6 months; after that, they will be subject to the new regulations of the Government.

In cases where civil servants and professional staff are appointed to leadership and management positions at the commune level, the leadership allowance will temporarily not be applied until the Government issues regulations.

In addition, policies on job reclassification, salary classification, early retirement, voluntary resignation, etc., are required to be implemented promptly, ensuring harmony, stabilizing the morale of staff, and creating consensus within the workforce.

The Steering Committee requests that the Standing Committees of the Provincial and City Party Committees directly under the Central Committee, based on relevant Central regulations and the guidance in this document, proactively research and review the standards, conditions, and personnel arrangement plans for the new commune-level units, ensuring suitability, balance, and harmony between current provincial and district-level officials and civil servants and commune-level officials and civil servants to meet the political tasks of the new commune-level administrative units.

The provincial People's Committee directs relevant agencies to implement the new commune-level personnel arrangement according to the plan approved by the competent authority; and to promptly implement policies and regulations for cases of voluntary early retirement, resignation, or failure to meet the standards and conditions for appointment as commune-level civil servants.

The assignment and placement of commune-level officials and civil servants must be thorough, democratic, objective, transparent, fair, impartial, and in accordance with the Party's principles and regulations; good political and ideological work must be carried out to create high unity and cohesion among officials and civil servants; at the same time, measures must be taken to address or promptly detect and propose to competent authorities for guidance and handling of related issues arising in practice. Any arising difficulties should be promptly reported to the Ministry of Interior for compilation and submission to competent authorities for consideration.
