The Ministry of Justice is reviewing the draft Decree on the management and use of civil servant staffing quotas, which was developed by the Ministry of Interior.
The draft Decree specifies the criteria for determining staffing levels and the authority to allocate civil servant staffing to ministries, sectors, and localities, including provincial and commune levels.

Basis for determining the number of civil servants
Accordingly, the civil servant staffing levels are based on job positions and the workload of each position, according to the functions, duties, powers, and organizational structure of administrative organizations.
The draft regulations stipulate that the number of civil servants is still affected by many factors such as: improvements in processes, changes in operating methods and working regulations; the level of modernization of equipment and working tools; the application of information technology, reform and simplification of administrative procedures, digital transformation; as well as the process of decentralization and delegation of authority.
Furthermore, the civil servant staffing levels are also based on the actual management and utilization of the allocated civil servant staffing quota and the signing of contracts for the performance of certain tasks by civil servants as stipulated in Article 21 of the Law on Cadres and Civil Servants.
For administrative organizations at the provincial and commune levels, determining staffing levels must be based on the number and classification of commune-level administrative units, population size, natural area, level of socio -economic development, and other specific factors of each locality.
Authority to allocate personnel quotas at ministries and local levels.
The draft Decree also clearly defines the authority of ministries and localities to decide on the allocation of civil servant positions.
Based on the five-year and annual civil servant staffing quotas allocated by competent authorities, the Minister of Home Affairs will decide on the allocation of civil servant positions to each Ministry before October 1st of the year preceding the planning year or planning period. Based on these quotas, the heads of ministries will decide on the annual allocation of civil servant positions to each agency under their management before October 31st of the preceding year.
At the local level, the Provincial People's Committee develops annual plans for allocating civil servant positions to agencies using civil servant positions at the provincial and commune levels.
At the same time, the Provincial People's Committee is also responsible for submitting to the Provincial People's Council for decision the annual allocation of civil servant positions in the Committees of the Provincial People's Council, administrative organizations under the Provincial People's Committee, the Committees of the Commune People's Council, and administrative organizations under the Commune People's Committee. This allocation is carried out within the scope of the annual civil servant positions allocated by the competent authority before October 1st of the year preceding the planning year.
For representative offices, based on the five-year and annual staffing quotas allocated by competent authorities, the Minister of Foreign Affairs will issue a decision assigning the annual staffing quota for each ministry to the representative office before October 1st of the year preceding the planning year.
Based on that, the heads of ministries decide on the annual allocation of civil servant positions for representative offices under their management before October 31st of the year preceding the planning year.
Annually, the head of the ministry will directly decide on the allocation and adjustment of civil servant staffing for each representative office under its management.
According to the proposal, this Decree, once approved, will take effect from July 1, 2026, and replace the provisions on civil servant staffing in Decree 62/2020 on job positions and civil servant staffing.
