The Ministry of Construction is seeking feedback on a draft Circular stipulating: the procedures for initial inspection and exemption from inspection for motor vehicles and specialized vehicles; technical safety and environmental protection certification for modified vehicles; and exhaust emission testing for motorcycles and mopeds. This draft will replace Circular 47/2024/TT-BGTVT.
Only check data on violating vehicles on the Vietnam Registering Authority's software.
A notable highlight of the draft is the clear regulation that: data on vehicles that have violated regulations and been refused inspection is data retrieved from the vehicle violation notification software of the Vietnam Registering Agency, as stipulated in Clause 1, Article 43 of the Law on Road Traffic Safety.
According to the Vietnam Registering and Inspection Department, the addition of this regulation aims to guide inspection facilities on how to identify vehicles that are refused inspection due to unresolved administrative violations related to road traffic order and safety.
Therefore, instead of having to check traffic violation data simultaneously on both the Traffic Police Department's and the Vehicle Registration Department's lookup pages as is currently the case, when the new regulation is approved, vehicle registration centers will only check the data from the Vehicle Registration Department.
Specifically, Article 14 of the draft Circular on handling arising cases states: if the Vehicle Registration Department's information system still shows the status "not yet completed," but the vehicle owner provides evidence of completion (including minutes, penalty decisions, and payment receipts), the registration facility will update these documents in the system as a basis for conducting the vehicle inspection.
According to vehicle inspection centers, this regulation provides maximum convenience for citizens and businesses. In reality, in the past, many cases have been reported where vehicles had paid traffic fines but were still denied registration because the system had not been updated and still displayed the status "no fines issued".
The Vietnam Registering and Inspection Department further stated that the new regulations reflect the spirit of putting the people at the center, transparentizing the processing procedures, and avoiding unreasonable refusal of inspection when vehicle owners have already fulfilled their obligation to pay fines, causing a waste of time and effort.
In addition, the draft Circular also includes guidance on handling cases where the software for searching information on violating vehicles of the Department of Vehicle Registration or the sharing of vehicle registration data from the police force encounters unforeseen problems.
Accordingly, the vehicle inspection facility will continue to conduct inspections as required. Once the problem is resolved, if it is found that the vehicle is subject to rejection, the inspection facility will notify the owner and revoke the inspection certificate and sticker. If the vehicle is not subject to rejection, a new certificate will be issued and the owner notified.
Mandatory verification of vehicle registration data upon acceptance of vehicle inspection.
In Article 14 of the draft, the Ministry of Construction also proposes a method for handling cases arising related to vehicle registration documentation and vehicle registration data lookup.
Specifically, if the vehicle inspection management software cannot be used due to force majeure, the inspection facility is permitted to create paper records. After the system is restored, the data must be fully updated in the system.
If the vehicle inspection facility discovers discrepancies between the information regarding vehicle manufacturing, assembly, or import and the actual situation, they will stop processing the application, notify the vehicle owner, and report the issue to the Department of Vehicle Registration for coordinated action. Processing will only resume upon confirmation of the discrepancies.
For vehicles that have been confiscated and auctioned but whose data is not in the system, the vehicle inspection facility will create a technical specifications confirmation document, along with supporting documents such as the manufacturer's announcement or the inspection results from a competent authority.
If the vehicle registration data does not match the data from the Vehicle Registration Department, the registration facility will refuse to accept the application and request the vehicle owner to contact the vehicle registration authority for resolution.
If the vehicle owner presents documents but the data cannot be retrieved or the data does not match, the vehicle inspection facility will refuse to accept the application and notify the police for handling according to regulations.
Therefore, according to the new proposal, even with vehicle registration papers, inspection centers will still be required to cross-reference the data with that provided by the police, in order to prevent document forgery.
Adding flexible yet rigorous handling options for emerging situations not only helps the vehicle inspection system operate smoothly but also creates a multi-layered data "filter," enhancing management and transparency in inspection activities.
