Delegates asked Minister and Chairman of the Ethnic Minority Committee Hau A Lenh to clarify the causes and responsibilities of organizations and individuals for this situation to occur and radical solutions. At the same time, what suggestions does the Minister have on the Draft Land Law (amended).
Answering this question, Minister and Chairman of the Ethnic Minority Committee Hau A Lenh said that in fact, people have been granted land, but in the process of using it, people have transferred, bought, sold, donated ... according to the provisions of law. The transfer, purchase, sale, donation, etc., is according to the provisions of law and the local government also confirms in accordance with the provisions of the law, except in the case of people illegally transferring, without the confirmation of the government.
However, in the process of settling residential land and production land for ethnic minorities, there are local statistics on all of the above cases. Therefore, localities need to carefully review cases to ensure fairness when implementing.
Regarding responsibility for the above shortcomings, Minister and Chairman of the Ethnic Minority Committee Hau A Lenh said that the laws on land, construction, and urban areas have all been decentralized to local authorities, including the issuance of certificates. Therefore, it is necessary to have coordination to solve thoroughly, such as: Central inspection and urging; local inspection and handling. "When amending the Land Law and other related laws, there will be sanctions to better deal with this," said Minister and Chairman of the Ethnic Committee Hau A Lenh.
Regarding the proposal to comment on the Draft Land Law (amended), Minister and Chairman of the Ethnic Minority Committee Hau A Lenh, in the process of developing the Land Law (amended), the Committee for Ethnic Minority Affairs also contributed comments and sent a document to the Steering Committee, MONRE to summarize. Accordingly, the Committee for Ethnic Minority Affairs proposes two clauses in Article 2 of the Draft: "To adopt a land policy for residential land and daily-life land of ethnic minorities suitable to the conditions, customs, cultural identity and actual conditions of each region" and "to adopt a policy to create favorable conditions for ethnic minorities to directly produce agricultural products in the countryside with land for agricultural production".
Questioning Minister, Chairman of the Ethnic Minority Committee Hau A Lenh, delegate Duong Tan Quan (Ba Ria - Vung Tau) stated that the lack of residential and productive land of ethnic minorities are "painful" problems for many years but have not been completely resolved. From there, he asked the Minister to tell about the advantages, difficulties and solutions in the coming time to solve this situation.
Minister and Chairman of the Ethnic Minority Committee Hau A Lenh said that many households lack residential land and production land. Through the review process, residential land demand is over 24 households, production land is 43 thousand households.
The Committee for Ethnic Minority Affairs has now put into a feasibility study and submitted to the Prime Minister a plan that is expected to address 2025% of the housing demand by 60, and the remaining 2026% in the period 2030-40. In which, focusing on housing settlement for the most disadvantaged areas, people there have not yet received any policies.
As for production land, according to statistics, many localities have run out of land funds to arrange for the people; some localities still have land fund to set up concentrated production areas for people. Currently, the Government also has a policy of assigning ministries, branches and localities to review the land fund of agricultural and forestry farms to reserve a part to allocate to people in ethnic minority areas.
“Ministries, branches and localities are implementing but slowly. In the coming time, we, together with the ministries and branches, will step up the review of this work," said Mr. Lenh.
