Innovation in legal aid work of 2-level government model, province merger

The seminar was attended by leaders of the Legal Aid Department, Ministry of Justice; leaders of the Department of Justice of Bac Kan , Ha Giang, Thai Nguyen, Phu Tho provinces; leaders of the Provincial People's Court, Legal Aid Centers and representatives of a number of relevant departments, agencies, sectors and organizations.

On April 9, 2025, the Ministry of Justice issued Official Dispatch No. 1866 guiding the implementation of tasks under the management of the Ministry of Justice in organizing two-level local governments; including guidance on the field of legal aid. In order to promptly grasp difficulties and problems in localities in this field, the Department of Dissemination, Education of Law and Legal Aid organized work with localities in the spirit of promoting decentralization to local governments, and at the same time proposed solutions to improve the quality and effectiveness of legal aid work.

Discussing at the seminar, delegates emphasized that in the current context, the arrangement and merger of provincial and communal administrative units and the organization of a two-level local government system have a direct impact and influence on the work of the judiciary in general and legal aid work in particular. Based on the actual situation in the locality, the establishment of a State Legal Aid Center in the province is carried out in accordance with the needs of legal aid in the province. In addition, it is necessary to maintain the apparatus and number of employees, for the decentralization of some tasks from the Central to the local level. This is a step to increase the initiative of the locality. When empowered, the locality will directly direct the implementation and at the same time be responsible for its results...

In the coming time, the Department of Dissemination, LegalEducation and Legal Aid recommends that localities continue to closely follow the directions of the Party, the State, and the Steering Committee to reorganize administrative units at all levels and build a model of organizing a 2-level local government so that legal aid work in the area is truly of quality, effective, and uninterrupted. Thereby contributing to ensuring that eligible people have timely and convenient access to legal aid services. In the coming time, the Department will continue to coordinate with localities to research and advise on solutions to innovate legal aid work to meet the current new stage.
