
In accordance with Clause 7, Article 111 of the 2024 Land Law, the Provincial People's Committee has stipulated a reward mechanism for those whose residential land is reclaimed and handed over ahead of schedule in Article 6 of Decision No. 43 dated October 28, 2024. However, this only stipulates a reward mechanism for residential land reclaimed and handed over ahead of schedule, as Clause 7, Article 111 of the 2024 Land Law does not provide for a reward mechanism for those whose agricultural land and non-agricultural land (excluding residential land) is reclaimed. Therefore, to ensure fairness for those whose land is reclaimed (including both agricultural land and non-agricultural land (excluding residential land)), and to contribute to accelerating the progress of land clearance for projects in the province, the Provincial People's Council has issued Resolution 03.
Mr. Nguyen Van Hanh, Deputy Director of the Department of Agriculture and Environment, informed: In implementing Resolution No. 03, based on the assigned tasks, the department issued document No. 783 dated April 17, 2024, to implement the policy. The implementation has received attention from all levels and sectors and has initially achieved positive results, contributing to accelerating the progress of land clearance, especially for key projects in the province.
Accordingly, all levels and sectors have intensified propaganda efforts to inform the people about Resolution No. 03 and the support levels under the resolution, especially in areas where projects are being implemented. Mr. Nguyen Chien Hiep, Chairman of the People's Committee of Dinh Lap commune, said: After Resolution No. 03 was issued, the commune has disseminated the content of the resolution to a large number of people, especially households affected by projects in the area. Based on public opinion, people are very supportive of the policy. This encourages households to hand over land early so that contractors can effectively carry out the projects and ensure progress.
Since Resolution 03 came into effect (April 8, 2025), according to preliminary review results, more than 1,000 cases in the province have benefited from the reward policy, with a total amount exceeding 6.5 billion VND. Mr. Duong Van Mach, from Khon Pat Hamlet, Dong Kinh Ward, shared: "My family has more than 1,000 square meters of rice paddy land affected by the Provincial Sports Complex Project. Through the dissemination of information, we understood the significance of the project and the reward policy for early land handover, so we voluntarily handed over the land to the contractor. My family received a reward of 10 million VND according to Resolution 03. This is a meaningful policy, a source of encouragement for people to hand over land early."
It can be said that the issuance and implementation of Resolution No. 03 has created an impetus to encourage people to voluntarily hand over land before the deadline, contributing to reducing delays, prolonged complaints, and limiting the need to apply administrative coercive measures.
According to Resolution No. 03, the reward policy for those whose land is being reclaimed (agricultural land and non-agricultural land other than residential land) and who hand over the land ahead of schedule as requested in the initial handover document from the unit or organization responsible for compensation, support, and resettlement, is specifically stipulated as follows: A monetary reward of 10% of the total compensation and support value for reclaimed agricultural land, with a maximum reward of no more than 10 million VND per person; a monetary reward of 40,000 VND/m2 for reclaimed non-agricultural land other than residential land, with a maximum reward of no more than 10 million VND per person. |
