Officers, professional non-commissioned officers, professional and technical non-commissioned officers, professional soldiers, workers in agencies and units of the People's Police and the People's Army; cadres, civil servants and public employees in accordance with the law on cadres, civil servants and public employees; subjects who have returned official residences; households and individuals subject to land recovery and having to have their houses cleared or demolished in accordance with law but have not yet been compensated by the State with houses or residential land.
Regarding the conditions to buy social housing: the subjects mentioned above must fully satisfy the conditions for housing (have no house or have a house but the average area is less than 10 mXNUMX.2/People); residence (must have permanent residence registration or confirmation of temporary residence registration and confirmation of social insurance payment for 1 year or more in the province or city directly under the Central Government where the construction investment project is located. social housing); income (not subject to personal income tax, ie income less than or equal to 11 million dong, after deducting family circumstances 4,4 million dong/person). Each household and individual is only entitled to receive social housing purchase support once.
According to Mr. Sinh, depending on each subject, the housing law has specified the certification of subjects, housing conditions, residence conditions, income conditions for the People's Committees of districts and communes. , public housing management agencies, training institutions and related agencies. The investor is responsible for receiving the dossier, making a list of people expected to buy social housing and sending it to the construction department.
Next, the Department of Construction is responsible for coordinating with relevant agencies (District People's Committee, Taxation, Natural Resources) to check the list of objects expected to be purchased, rented, or leased-purchased social housing.
At the same time, the Department of Construction is responsible for updating the list of objects that are allowed to buy, rent, or lease-purchase social housing on the web portal of the Department of Construction and the Ministry of Construction, so that relevant agencies can can check and monitor subjects and conditions as well as ensure that each object is only supported for social housing once.
If the wrong person buys social housing, it must be withdrawn

In order to correct the above situation and ensure the sale and purchase of social housing in accordance with the provisions of the law, the Ministry of Construction has sent a document to a number of localities (such as Hanoi, Bac Ninh, Bac Giang...), request the People's Committee of the province to direct the functional agencies to organize the inspection and clarification of the negative information reflected by the press and media agencies; strictly handle violations according to their competence and send reports on settlement results to the Ministry of Construction.
In the coming time, the Ministry of Construction will continue to coordinate with localities to strengthen inspection and examination, and gradually correct the implementation of legal regulations on housing, including social housing.
The Ministry of Construction also suggested that local authorities should specify and publicly announce standards, subjects and conditions for buying social housing; organize management and closely monitor the purchase and sale; organize the inspection, examination, supervision and handling of violations related to the purchase and sale of social housing in the locality; sanction for acts of violation on sale, lease, lease-purchase of social housing that do not meet the right subjects, do not meet the conditions as prescribed (a fine of from 40 to 60 million VND).
Promptly take remedial measures to force the withdrawal of social housing and forcibly return the purchase, rent, or lease-purchase payment to the purchaser or lessee in accordance with the provisions of Decree No. 16/2022/ Decree-CP dated January 28.1.2022, XNUMX of the Government on regulations on sanctioning of administrative violations in the field of construction.
The Deputy Minister of Construction requested enterprises to strictly comply with the law on buying and selling social houses, selling them at the right prices approved by competent authorities.
