According to the conclusions of the inspection on the state management responsibility for planning and implementation of construction planning by the People's Committee of Ho Chi Minh City (period from 2015-2022), this unit recommended that Ho Chi Minh City recover 802 billion VND from projects that owe land use fees.
Authorities are recovering hundreds of billions of dong in outstanding land use fees from real estate projects.
Specifically, the Van Gia Phuc social housing and commercial housing project (District 6) was granted a construction permit by the Department of Construction, but the number of floors recorded (excluding the rooftop stairwell) did not comply with regulations.
The project did not allocate space for a kindergarten as required by regulations, and the investor has yet to fulfill its financial obligations regarding land, amounting to over 159 billion VND.
Regarding the Richstar Residence project (Tan Phu district), developed by Nova Richstar Company (a subsidiary of Novaland), the Government Inspectorate stated that the Ho Chi Minh City People's Committee had adjusted the planning but did not take into account the additional land use fees.
Instead, the city allowed Novaland to make a provisional payment of 1,083 billion VND for 8 projects in the area, with the provisional payment for Richstar Residence alone being 242.5 billion VND.
However, this calculation is considered to lack legal basis. The company has yet to fulfill its financial obligations for the project, with the estimated land use fee being approximately 446 billion VND.
These are projects that have been handed over but have not yet completed their financial obligations, so residents have not been issued land ownership certificates; if they complete their financial obligations as concluded, they will be granted ownership documents.
Meanwhile, in Binh Chanh district, the commercial, service and housing complex project at Lot F (Tan Tuc town) and the An Ha residential area (Pham Van Hai commune) were also singled out, as Western City Co., Ltd. (Lot F project) and Nhut Thanh Joint Stock Company (An Ha project) have not yet paid the total estimated land use fee of over 197 billion VND.
The construction project was built in violation of the permit.
Regarding construction planning, the Government Inspectorate pointed out that at the Tan Thang Sports and Residential Complex project (Tan Phu District), commercially known as Celadon City, Gamuda Land (a Malaysian company) had constructed mezzanines in apartments on the 16th floor, which was inconsistent with the construction permit. Despite this, the design was still approved by the Ministry of Construction and the Ho Chi Minh City People's Committee made localized adjustments to the detailed planning.
Regarding the construction permit for apartment block A1 in the project's revised detailed planning scheme, the Department of Construction issued the permit but failed to define the building boundaries for the foundation. Furthermore, the investor constructed one to two basement levels in areas A1, A5, and A6 of the project, which is inconsistent with the approved detailed planning scheme.
Meanwhile, at the mixed-use commercial and residential project of Gotec Vietnam Co., Ltd. (District 6), the Department of Construction also issued a permit that violated regulations regarding the number of floors. Furthermore, the investor arbitrarily added kitchens to the design of some commercial and service apartments and failed to fulfill its financial obligations regarding the 20% social housing units as required by law.
The project's delays resulted in wasted capital.
The Government Inspectorate has pointed out that many projects in Ho Chi Minh City have not been implemented (stalled projects) or are behind schedule.
Typical examples include the Binh Quoi - Thanh Da urban area (426.93 hectares), the Northwest - Cu Chi urban area (approximately 6,000 hectares), Saigon Safari Park (approximately 456 hectares), Binh Trieu railway station (approximately 41 hectares), Xuyen Tam canal (6.7 km long), etc. According to the Government Inspectorate, these delayed projects waste capital and cause prolonged traffic congestion and flooding.
