The appeal before the EU Court of First Instance in Luxembourg concerns the designation of these platforms under the EU's Digital Markets Act (DMA). The DMA outlines what the world's largest digital platforms are allowed and not allowed to do, aiming to regulate them and create an open online space.
Meta faces stricter rules and obligations after being designated a "gatekeeper" under the DMA, and its Facebook, Instagram, and WhatsApp products are subject to closer scrutiny as they are considered "core platform services" under the law.
However, the American tech giant filed a lawsuit in November 2023, arguing that the Messenger and Marketplace apps are both extensions of Facebook and do not face their own strict obligations.
The court's statement clarifies the annulment of the decision designating Meta as the gatekeeper for Marketplace, while upholding Meta's designation for the personal communication app Messenger.
Regarding the classification of Marketplace as a "core platform service" subject to stricter regulations, the court found that the European Commission (EC) had made "legal errors" on several points, specifically that the EC had failed to take into account changes made to the platform in mid-2023, and deemed their case "lacking compelling reasoning".
However, with regard to Messenger, the court agreed with the EC that the messaging platform "is distinct from the Facebook social network," noting that the platform "is offered through standalone applications" and that "Meta promotes tools specific to that service."
Besides Meta, other "big players" designated as "gatekeepers" under the DMA include TikTok's owner ByteDance (China), Google's parent company Alphabet, Amazon, Apple, Booking, and Microsoft.
In 2025, the EU imposed its first fines for violations of the DMA rule, fining Meta and Apple €200 million ($232 million) and €500 million ($580 million) respectively. These fines sparked accusations from the US that the EU was deliberately targeting American companies. Brussels denied these allegations.
