If a primary school teacher registers a business, declares taxes, and offers a communicative English program (for children aged 7 to 10), instead of teaching the Ministry's curriculum, and parents proactively enroll their children in the program, is this a violation of regulations? Article 3 of Circular 29/2024/TT-BGDĐT, which regulates supplementary teaching, states the following principles: Supplementary teaching and learning may only be organized when students (hereinafter referred to as students) have a need for supplementary learning, voluntarily participate, and have the consent of their parents or guardians (hereinafter referred to as parents). Schools, organizations, and individuals organizing supplementary teaching and learning are prohibited from using any form to force students to participate.
The content of supplementary teaching and learning must not violate Vietnamese law, and must not be prejudiced based on ethnicity, religion, occupation, gender, or social status. The content of the school's curriculum must not be reduced to make way for supplementary teaching.
Extracurricular tutoring must contribute to the development of students' qualities and abilities; it should not interfere with the school's educational program or the teachers' implementation of the subject curriculum.
The duration, time, location, and format of supplementary tutoring must be appropriate to the psychological and physiological development of the age group, ensuring the health of students; complying with legal regulations on working hours, overtime hours, and legal regulations on security, order, safety, environmental hygiene, and fire prevention in the area where supplementary tutoring classes are held.
The concept of supplementary teaching and learning is clearly defined in Clause 1, Article 2 of Circular 29/2024/TT-BGDĐT. Accordingly, supplementary teaching and learning refers to additional teaching and learning activities beyond the time allotted in the educational plan for subjects and educational activities (collectively referred to as subjects) in the General Education Program, the Continuing Education Program at the lower secondary level, and the Continuing Education Program at the upper secondary level, as issued by the Minister of Education and Training .
Based on the regulations mentioned above, your organization of English language teaching outside the general education curriculum does not fall within the scope and application of Circular No. 29/2024/TT-BGDĐT.
