What types of documents need to be reissued when provinces or cities merge?

1. Is it mandatory to change documents when provinces or cities merge?

According to Article 10 of Resolution 190/2025/QH15, the regulations on document conversion for individuals and organizations are as follows:

Documents issued by competent authorities before the reorganization of the state apparatus that have not yet expired or reached their expiration date shall continue to be applied and used in accordance with the law until their expiration date or until they are amended, supplemented, replaced, repealed, canceled, or withdrawn by the agency or authority assuming the functions, tasks, and powers, or by the competent authority or person.

Accordingly, organizations and individuals are not allowed to be required to renew documents issued by competent authorities or positions before the restructuring of the state apparatus if these documents have not yet expired, except in cases where the law stipulates otherwise.

Therefore, according to the above regulations, citizens are not required to change their documents when provinces or cities merge if those documents are still valid.

2. What types of documents need to be reissued when provinces and cities merge?

As mentioned above, it is not mandatory for citizens to change their documents when provinces or cities merge. However, whether before or after the merger, citizens must have their documents reissued if they fall into one of the following categories:

(1) Citizen ID

According to Clause 1, Article 46 of the 2023 Law on Identity Cards, Citizen Identity Cards issued before July 1, 2024, remain valid until the expiration date printed on the card. Citizens may exchange their old cards for new Citizen Identity Cards if needed.

In addition, Clause 1, Article 24 of the 2023 Identity Card Law stipulates the following cases for issuing replacement or reissuing identity cards:

- For those who have reached the age to renew their identity card:

According to Article 21 of the 2023 Identity Card Law, Vietnamese citizens who have been issued an identity card must go through the procedure to renew their identity card when they reach the ages of 14, 25, 40, and 60.

In cases where an identity card has been issued, replaced, or reissued within two years prior to the age for identity card replacement as stipulated above, it remains valid until the next age for identity card replacement.

Accordingly, in 2025, people born in 2011, 2000, 1985, and 1965 will be 14, 25, 40, and 60 years old, respectively.

Therefore, those born in 2011, 2000, 1985, and 1965 need to apply for a new Citizen Identity Card before their old card expires, except for cases where the card has been issued, replaced, or reissued within two years prior to the age for card renewal.

- Individuals whose information has been changed, or whose National Identity Card has been lost or damaged.

Cases requiring replacement of identity cards include:

- It's time to renew your identity card.

- Changes and corrections to information regarding surname, middle name, given name; date of birth;

- Changes in identity; addition of facial and fingerprint information; gender reassignment or gender transition as prescribed by law;

- There are errors in the information printed on the identity card;

- At the request of the cardholder when the information on the card changes due to administrative unit reorganization;

- Re-establish your personal identification number;

- When the person issued the identity card requests it.

In addition, citizens are reissued identity cards in the following cases:

- Loss of identity card or loss of identity card rendering it unusable, except in cases stipulated in Article 21 of the 2023 Identity Card Law;

- To regain Vietnamese citizenship in accordance with the provisions of Vietnamese law on citizenship.

(2) Driving license

According to Article 62 of the 2024 Law on Road Traffic Safety, holders of driver's licenses may exchange or reissue their licenses in the following cases:

- My driver's license is lost;

- The driver's license is damaged and no longer usable;

- Before the expiration date stated on your driver's license;

- Changes to the information recorded on the driver's license;

- A valid foreign driver's license issued by a competent authority of a foreign country;

- Driving licenses issued by the Ministry of National Defence or the Ministry of Public Security upon request or when the license holder is no longer serving in defence or security duties.

Furthermore, point d of Article 21 of Circular 12/2025/TT-BCA, which regulates driver's license examinations and issuance, stipulates the procedures for exchanging driver's licenses:

d) In cases where the date of birth, surname, given name, middle name, nationality, place of birth, and place of residence recorded on the driver's license differ from the information on the citizen identification card or identity card, the competent authority shall process the issuance of a new driver's license that matches the information recorded on the citizen identification card or identity card;

Therefore, when provinces and cities merge and citizens change their Citizen Identity Card/ID card, the competent authority will process the issuance of a new driver's license that matches the information recorded in the Citizen Identity Card or ID card; if citizens do not change their Citizen Identity Card, they do not need to change their driver's license.

(3) Red book, pink book

Based on Clause 21, Article 13 of Circular 10/2024/TT-BTNMT regulating information on changes in land and assets attached to land: In case of changes in the name of an administrative unit or adjustments to administrative boundaries according to decisions of competent state agencies, it should be stated as follows: "Change of name... (record the name of the administrative unit before the change) to... (record the new name of the administrative unit)".

At the same time, Clause 19 of Article 41 of Circular 10/2024/TT-BTNMT also clarifies that the confirmation of changes on the issued certificate for cases of registration of changes in land and assets attached to land is as follows:

In cases where the name of an administrative unit is changed or the administrative boundaries are adjusted according to a decision of a competent state agency, the issued certificate shall reflect the content as stipulated above.

However, according to Official Letter 991/BNNMT-QLĐĐ of 2025, it is clearly stated:

After the administrative unit reorganization, it is not mandatory to simultaneously update all issued certificates. Except for two cases where land ownership certificates (red and pink certificates) will be updated and reissued:

- Land users and owners of assets attached to the land who have a need;

- Land users can amend or replace their land use right certificates (red or pink certificates) simultaneously with other administrative procedures related to land.

For example, when subdividing land or registering land ownership changes, the land title certificate (red or pink certificate) will be updated and reissued with the new information.

In summary, it is not mandatory to replace the land use right certificate (red or pink certificate); the replacement with a new certificate is only carried out when the land user or property owner so desires, or when it is done concurrently with other land-related administrative procedures.
