
Flight operations at the airport must comply with the instructions of the ATS facility.
Principles of flight operations at the airport
An ATS facility is a facility established to provide regulated air traffic control services.
Regarding flight operations at the airport, the Decree stipulates that flight operations at the airport must comply with the instructions of the ATS facility, flight regulations, flight procedures, operating procedures, and operational processes at the airport as published.
Organizations and individuals participating in flight operations at the airport are responsible for coordinating to ensure safety, security, operational capacity, and timely handling of unusual or emergency situations.
Regulations governing flight operations, flight procedures, and operational procedures within shared airport areas.
The decree stipulates that the issuance of flight regulations, flight procedures, and operational procedures within shared airport areas must ensure compliance with the direct airport management authority, national defense requirements, security, and flight safety.
For shared airports under the management of the Ministry of Construction , the Civil Aviation Authority of Vietnam announces flight procedures and operational procedures within the airport area after consulting with the Air Defense - Air Force Command and relevant agencies.
For shared airports under the management of the Ministry of National Defence , the Air Defence - Air Force Command issues flight regulations within the airport area after consulting with the Civil Aviation Authority of Vietnam.
For shared airports under the management of the Ministry of Public Security , the competent authority under the Ministry of Public Security shall issue flight regulations within the airport area after consulting with the Air Defense - Air Force Command and the Civil Aviation Authority of Vietnam.
The Civil Aviation Authority of Vietnam publishes in the Vietnam AIP (Airport Information Protocol) the flight procedures, operating procedures, and operational data related to civil aviation operations at shared airports in accordance with regulations on aviation information.
Flight operations within shared airport areas must comply with established flight regulations, flight procedures, operational procedures, and coordination mechanisms between civil aviation and the armed forces.
Authority to grant, modify, and revoke flight permits
Regarding the authority to grant, amend, and revoke flight permits, the Decree stipulates the following:
1. The Consular Department of the Ministry of Foreign Affairs issues, amends, and revokes flight permits for:
a- Special flights of foreign aircraft carrying heads of state, legislative bodies, and governments of other countries on state visits, official visits, working visits, or personal visits to Vietnam;
b- Flights carrying guests of the Party and State, flights performing diplomatic duties;
c- Flights performing escort, advance, or related missions to the VIP flight mentioned in points a and b above.
2. The Operations Department under the General Staff of the Ministry of National Defense issues, modifies, and revokes flight permits for:
a- Flights of military aircraft conducting civilian flight operations in Vietnam;
b) Flights of military aircraft participating in search and rescue operations within Vietnam's flight information region or within areas under Vietnam's jurisdiction;
c) Flights of civilian aircraft transporting weapons and war equipment as stipulated in Clause 3, Article 61 of the Vietnamese Civil Aviation Law, after being authorized by the Minister of National Defense to transport them by air to, from, or fly over Vietnamese territory;
d- Civil aviation flights operating outside of designated air routes;
d- Flights performing civil aviation operations as stipulated in Clause 3 of Article 5 and Article 6 of this Decree.
3. The competent authority under the Ministry of Public Security shall issue, amend, and revoke flight permits for flights performed by aircraft of the Ministry of Public Security for official purposes and to ensure security and order as prescribed. The Minister of Public Security shall specify the detailed procedures for issuing, amending, and revoking flight permits under his/her authority.
4. The Vietnam Civil Aviation Authority, under the Ministry of Construction, issues, amends, and revokes flight permits for:
a- Flights conducting civil aviation operations in Vietnam, including flights of civil aircraft participating in search and rescue operations, and not falling within the scope of regulations in clauses 1, 2, and 3 above;
b- The Vietnamese charter flight is operated by Vietnamese airlines;
c- Foreign charter flights are not covered by the provisions of clause 1 above.
5. The Vietnam Air Traffic Management Corporation shall issue, amend, and revoke flight permits for civil aviation operations in Vietnam as stipulated in Clause 4 above in cases where the request for flight permit is submitted on weekends, holidays, or outside of business hours, and the flight is scheduled to take place before 09:00 AM on the next working day, specifically as follows:
a- Flights transporting mechanics, engines, equipment, and devices for servicing and repairing damaged aircraft; flights transporting passengers, baggage, cargo, and mail from damaged aircraft or transferring aircraft to other locations for this purpose; flights resuming operations after technical problems have been resolved;
b) Search, rescue, emergency, medical, and salvage flights by aircraft registered under foreign nationality;
c- Domestic flights with ferry transfers; technical inspection flights;
d- Flights of Vietnamese civil aircraft serving official purposes;
d - Flight for humanitarian purposes;
e. Modification of the following contents of the flight permit: aircraft change for non-commercial reasons; aircraft change for commercial reasons for domestic flights; change of departure and arrival airports after mandatory diversion due to weather, technical, humanitarian, or safety reasons; change of flight number due to delay to the next day; change of departure and arrival airports outside the territory of Vietnam for flights passing through Vietnamese airspace.
6. The Vietnam Air Traffic Management Corporation shall carry out the procedures for granting, amending, and revoking flight permits as stipulated in Clause 5, in accordance with Article 17 of this Decree.
7. In urgent cases to ensure flight safety, air traffic controllers directly managing a flight have the right to issue instructions to change the flight plan for an aircraft in flight. The facility directly managing the flight is responsible for immediately notifying the relevant regional Air Traffic Management Center about the issuance of instructions for that flight.
8. The Vietnam Air Traffic Management Corporation is responsible for receiving, reviewing, and providing feedback on the Air Traffic Flight Plan stipulated in Clause 7, Article 17 and the Flight Execution Plan stipulated in Article 24 of this Decree. This feedback serves as a substitute for flight permission.
Decree 222/2026/ND-CP takes effect from July 1, 2026.
