Ho Chi Minh City People's Court will hold the first instance trial of the inheritance dispute of the late Meritorious Artist Vu Linh on December 16.
Speaking to Thanh Nien , lawyer Nguyen Tuyet Ngoc (who protects Hong Loan's legal rights and interests) said that on December 16, the Ho Chi Minh City People's Court is expected to hold a first-instance trial of a civil case over the inheritance dispute of the late Meritorious Artist Vu Linh between the plaintiff, Ms. Vo Thi Hong Nhung (Meritorious Artist Vu Linh's sister) and the defendant, Ms. Vo Thi Hong Loan (Meritorious Artist Vu Linh's daughter).
Those with related rights and obligations include: Ms. Le Thi Hong Phuong, Mr. Vo Thanh Nhieu (brother of Meritorious Artist Vu Linh), Huynh Thi Ngoc Yen Notary Office (Ward 14, Binh Thanh District, Ho Chi Minh City), Phu Nhuan District People's Committee and a number of other individuals.
Before deciding to bring the case to trial, the Ho Chi Minh City People's Court held meetings to examine the submission, access, disclosure of evidence and mediation. Here, the parties had access to documents and evidence related to the dispute; including the conclusion of the signature appraisal of the late Meritorious Artist Vu Linh. The conclusion of the Institute of Criminal Science No. 4993/KL-KTHS showed that there was not enough basis to conclude whether the signature on the adoption handover document and the adoption handover certificate issuance book compared with the signature of Meritorious Artist Vu Linh on the sample documents were signed by the same person or not. As a result, the mediation session failed because the parties did not agree to mediation.
Previously, Hong Loan, Hong Phuong and their lawyers came to the conciliation meeting but neither side agreed to conciliate.
According to the developments of the dispute, the plaintiff requested the court to request an appraisal of the signature of the late Meritorious Artist Vu Linh on the adoption handover document and the adoption handover certificate book; cancel these documents and the inheritance declaration document of Ms. Hong Loan regarding the house and land at 5 Doan Thi Diem, Phu Nhuan District, Ho Chi Minh City; the right to use two plots of land in Linh Dong Ward, Thu Duc City, Ho Chi Minh City; cancel the updated change on the certificate of house at 5 Doan Thi Diem regarding the content of the transfer of the name to Ms. Hong Loan; request to determine that the entire legacy of the late Meritorious Artist Vu Linh is an inherited property owned by the second-order heirs.
On the defendant’s side, Hong Loan said she did not accept all of the plaintiff’s lawsuit requests. The defendant is the first heir and has submitted to the court all documents confirming that she is the legitimate child of Meritorious Artist Vu Linh. Ms. Loan filed a counterclaim, requesting Ms. Nhung and Ms. Le Thi Hong Phuong to move all of their assets out of house number 5 Doan Thi Diem.
Recently, the noisy dispute over the inheritance of Meritorious Artist Vu Linh has attracted public attention. The inheritance dispute of Meritorious Artist Vu Linh's family was accepted by the People's Court of Phu Nhuan District (HCMC) for first-instance settlement according to Notice No. 440/2023/TLST-DS dated June 5, 2023. On March 21, 2024, the People's Court of Phu Nhuan District (HCMC) decided to transfer the case file of the inheritance dispute of the late Meritorious Artist Vu Linh to the People's Court of HCMC, because it was not under its jurisdiction.
