The Ho Chi Minh City People's Court will hold the first-instance trial of the inheritance dispute involving the late Meritorious Artist Vu Linh on December 16th.
Speaking to Thanh Nien newspaper , lawyer Nguyen Tuyet Ngoc (who is defending Hong Loan's legal rights and interests) said that the Ho Chi Minh City People's Court is expected to hold the first-instance trial on December 16th for the civil case concerning the inheritance of the late Meritorious Artist Vu Linh between the plaintiff, Ms. Vo Thi Hong Nhung (Meritorious Artist Vu Linh's sister), and the defendant, Ms. Vo Thi Hong Loan (Meritorious Artist Vu Linh's daughter).
Those with related rights and obligations include: Ms. Le Thi Hong Phuong, Mr. Vo Thanh Nhieu (brother of Meritorious Artist Vu Linh), Huynh Thi Ngoc Yen Notary Office (Ward 14, Binh Thanh District, Ho Chi Minh City), Phu Nhuan District People's Committee, and several other individuals.
Before deciding to bring the case to trial, the Ho Chi Minh City People's Court held sessions to review the submission, access, and disclosure of evidence, as well as mediation sessions. During these sessions, the parties were given access to documents and evidence related to the dispute, including the forensic report on the signature of the late Meritorious Artist Vu Linh. The forensic report from the Institute of Criminal Science , number 4993/KL-KTHS, concluded that there was insufficient basis to determine whether the signatures on the adoption certificate and the adoption certificate register matched the signatures of Meritorious Artist Vu Linh on the comparison documents. As a result, the mediation session failed because the parties did not agree to a settlement.
Previously, Hong Loan, Hong Phuong, and their lawyer attended the mediation session, but neither party agreed to a settlement.
According to the developments in the dispute, the plaintiff requested the court to order an expert examination of the signature of the late Meritorious Artist Vu Linh on the adoption document and the adoption certificate; to annul these documents and the inheritance declaration of Ms. Hong Loan regarding the house and land at 5 Doan Thi Diem Street, Phu Nhuan District, Ho Chi Minh City; the right to use two plots of land in Linh Dong Ward, Thu Duc City, Ho Chi Minh City; to annul the updated changes on the certificate of ownership for house number 5 Doan Thi Diem Street regarding the transfer of ownership to Ms. Hong Loan; and to determine that the entire estate of the late Meritorious Artist Vu Linh is inherited property belonging to those in the second line of inheritance.
On the defendant's side, Hong Loan stated that she did not accept all of the plaintiff's claims. The defendant is a first-degree heir and has submitted all necessary documents to the court verifying her legal status as the daughter of Meritorious Artist Vu Linh. Ms. Loan filed a counterclaim, requesting that Ms. Nhung and Ms. Le Thi Hong Phuong remove all their belongings from house number 5 Doan Thi Diem.
Recently, the controversy surrounding the inheritance of Meritorious Artist Vu Linh has attracted significant public attention. The inheritance dispute involving Vu Linh's family was initially handled by the Phu Nhuan District People's Court (Ho Chi Minh City) according to notice No. 440/2023/TLST-DS dated June 5, 2023. However, on March 21, 2024, the Phu Nhuan District People's Court (Ho Chi Minh City) decided to transfer the case file regarding the inheritance dispute of the late Meritorious Artist Vu Linh to the Ho Chi Minh City People's Court, as it did not fall under its jurisdiction.
