Trend 24: Fierce debate about 'legitimate children' and inheritance declaration between Hong Loan and Hong Phuong's mother and child

On January 7, the Ho Chi Minh City People's Court opened the first instance trial of the inheritance dispute; requesting the cancellation of a separate decision and claiming a house for temporary residence related to the inheritance of Mr. Vo Van Ngoan (aka the late artist Vu Linh), between the plaintiff, Ms. Vo Thi Hong Nhung (younger sister of Meritorious Artist Vu Linh) and the defendant, Ms. Vo Thi Hong Loan (daughter of Meritorious Artist Vu Linh).

After nearly 6 hours of trial, the Ho Chi Minh City People's Court (HCMC People's Court) has issued a verdict in the inheritance dispute of the late Meritorious Artist Vu Linh.

Accordingly, the panel of judges partially accepted the plaintiff’s lawsuit, Ms. Vo Thi Hong Nhung. Accepted the counterclaim of Ms. Vo Thi Hong Loan, determining that Ms. Loan is the adopted daughter of artist Vu Linh, the first and only heir to the estate left by the late artist.

Ms. Hong Nhung received 15% of the inheritance of the late artist Vu Linh.

This asset includes a house and land at 5 Doan Thi Diem, Phu Nhuan District (HCMC), 3,007 square meters of land in Linh Trung Ward (Thu Duc City, HCMC), and a car registered under the name of artist Vu Linh.

The second heirs, Ms. Hong Nhung and Mr. Vo Thanh Nhieu, are not entitled to inherit the estate.

However, considering that during his lifetime, artist Vu Linh often traveled far away, Ms. Hong Nhung had contributed to taking care of the family, contributing and helping the artist create assets, the panel of judges decided to divide 15% of the value of the assets. From there, Ms. Hong Loan has the obligation to repay Ms. Nhung for her efforts in creating the assets. After the enforcement agency has the results of the asset valuation and the time limit for voluntary enforcement, Ms. Hong Loan has the obligation to refund Ms. Nhung 15% of the value of the inheritance.

After completing the repayment obligation, Ms. Hong Loan has the full right to use 3,007 square meters of land in Linh Trung ward and the right to own a car. After the prescribed time limit, if Hong Loan fails to complete the obligation, the enforcement agency will auction the above-mentioned assets to complete the enforcement obligation for Ms. Nhung. After Hong Loan has completed the repayment, she has the right to request Ms. Nhung and Hong Phuong to move out of house number 5 Doan Thi Diem.
