Constitutional amendment - a mandate from reality.

In the development process of every nation, the Constitution always holds a special position – as the fundamental law, the foundation of the entire legal system, and simultaneously reflecting the vision, development goals, and methods of organizing state power in each period. For Vietnam, in the context of the entire political system accelerating comprehensive reforms, especially the streamlining of the apparatus and the improvement of the effectiveness and efficiency of public institutions, amending the Constitution – with a focus on the organization of the political system – is an objective, inevitable, urgent requirement with profound historical significance.

In Conclusion No. 127-KL/TW dated February 28, 2025, on the implementation of research and proposals for further restructuring of the political system's organizational apparatus, the Politburo and the Secretariat assigned the Party Committee of the National Assembly to preside over and coordinate with the Party Committee of the Government to direct the Party Committee of the Committee on Law and Justice, the Party Committee of the Ministry of Justice , and relevant agencies to research the amendment and supplementation of several articles of the Constitution, focusing on issues related to the organizational structure of the political system.

At a recent meeting of the Standing Committee of the National Assembly Party Committee to discuss the draft plan for reviewing, amending, and supplementing the Constitution and laws of the State to serve the reorganization of the political system's apparatus, National Assembly Chairman Tran Thanh Man emphasized: "The nature and content of the work are crucial, the workload is very large, and it involves the responsibilities of many agencies and organizations, linked to the policy of streamlining and reorganizing the political system's apparatus."

That's absolutely right! Streamlining the apparatus is not simply about reducing the number of departments and cutting staff, but about scientifically and effectively reorganizing the power institutions to enhance national governance capacity and better serve the interests of the people. Amending the Constitution also aims not only to clarify the organizational model of the apparatus, but also to establish a stable and unified legal foundation for building and perfecting the legal system on the organization of the state apparatus in the future – including the Law on the Organization of the National Assembly, the Law on the Organization of the Government, the Law on the Organization of Local Governments…

As National Assembly Chairman Tran Thanh Man specifically emphasized: “The requirement is to be cautious, objective, democratic, scientific, and effective, demanding strict procedures and processes, ensuring quality, based on innovation and breakthrough thinking.” This is the core methodological principle that governs the entire process of amending the Constitution this time. Amending the Constitution is a particularly important process that needs to be conducted scientifically, meticulously, cautiously, and based on high social consensus. Each amended provision must not only stem from practical requirements and the long-term development of the country, but also be placed within the overall principles of a socialist rule of law state, ensuring political stability, institutional firmness, and strengthening social trust.

Amending the Constitution requires not only the participation of competent authorities but also the mobilization of the collective wisdom of the entire society. The process of soliciting public opinion on the proposed amendments and additions to the Constitution will be implemented over a period of one month, tentatively scheduled for May-June 2025. This is not merely a technical procedure, but a vivid manifestation of the spirit of democracy and the supremacy of the Constitution, clearly demonstrating the people's role in shaping the state's power structure. Simultaneously, the participation of experienced experts, scientists, and managers will ensure the scientific rigor, objectivity, and conformity with international practices in the amendment process. This is especially significant as Vietnam is actively building a modern rule-of-law state, proactively integrating into the global community, and enhancing its national standing.

Amending and supplementing the Constitution to streamline the political system is a historic task, reflecting the high political determination of the Party, the National Assembly, and the entire political system in this reform effort. The success of the constitutional amendment process will be an important legal and political prerequisite, creating momentum for major institutional transformations, contributing to the realization of the aspiration for rapid, sustainable, democratic, and prosperous national development.
