Draft circular amending and supplementing Article 11 of Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Minister of Industry and Trade regulating the origin of goods. Specifically, amending and supplementing Clause 2, Article 11 as follows: “2. The Import-Export Department issues C/O form A, C/O form B, non-preferential C/O according to the regulations of the importing country, CNM, C/O form GSTP. The Import-Export Department organizes the implementation of C/O issuance in accordance with current laws. The Import-Export Department and the agencies and organizations issuing C/O are responsible for guiding and explaining specifically and clearly the provisions in this Circular to traders requesting C/O issuance”.
The draft circular also supplements, replaces and abolishes a number of articles of Circular No. 38/2018/TT-BCT dated October 30, 2018 of the Minister of Industry and Trade regulating the implementation of certification of origin of goods under the general tariff regime of the European Union, Norway, Switzerland and Türkiye.
Specifically, amend and supplement Clause 4, Article 3 as follows: “4. The organization receiving the REX code registration is the Import-Export Department.” At the same time, amend and supplement Clause 4, Article 4 as follows: “4. The REX code registration is carried out online on the European Commission's website at customs.ec.europa.eu/rex-pa-ui, the Ministry of Industry and Trade's electronic certificate of origin management and issuance system at www.ecosys.gov.vn (eCoSys System).”
Amend and supplement Clause 5, Article 6 as follows: “5. Within 3 working days from the date of issuance, the trader shall declare and post the certificate of origin of goods under GSP and documents related to the export shipment as prescribed from point c to point h, Clause 1, Article 15, Decree No. 31/2018/ND-CP on the eCoSys System.”
The draft circular also amends and supplements Clause 1, Article 9 on the responsibilities of the Import-Export Department. Specifically, to develop and submit to competent authorities for promulgation or promulgate under their authority documents implementing the certification of origin of goods under GSP.
The Import-Export Department is the focal point for contacting agencies and organizations in Norway and Switzerland to implement the certification of goods origin under GSP; presides over and coordinates with relevant agencies, organizations and individuals to inspect the implementation of the certification of goods origin under GSP.
At the same time, it is responsible for organizing the implementation of registration and revocation of REX codes according to the provisions of this Circular and current legal regulations; disseminating the implementation of certification of origin of goods under GSP; urging, guiding, and answering questions of traders, ensuring publicity, transparency and convenience.
In addition, the Import-Export Department actively monitors, supervises, and inspects the implementation of GSP-based certificates of origin of goods by relevant traders, organizations, and individuals. The organization manages, preserves, and stores documents, records, and electronic data for at least 5 years from the end of the year of issuance for GSP-based certificates of origin of goods.
Previously, implementing the Law on Organization of the Government 2025, the Law on Organization of Local Government 2025, on April 21, 2025, the Minister of Industry and Trade signed and issued Decision No. 1103/QD-BCT. Accordingly, the Ministry of Industry and Trade revoked the right to issue Certificates of Origin (C/O), issue Certificates of unchanged origin of goods and receive registration of codes for certificates of origin of goods under the general preferential tariff regime of Norway and Switzerland for the Vietnam Federation of Commerce and Industry (VCCI). From May 5, 2025, the issuance of non-preferential C/O, CNM and registration of REX codes will be carried out at the C/O issuing agencies of the Ministry of Industry and Trade.
