The process of implementing administrative procedures in the industry and trade sector reveals numerous legal "bottlenecks," therefore, Lam Dong province is gradually addressing them to ensure consistency and feasibility.

Currently, localities are facing difficulties in implementing industrial promotion policies due to a lack of legal basis and specific guidelines on the level of financial support.

Many obstacles need to be overcome.

According to the Department of Industry and Trade, one of the major obstacles currently is the overlapping management of food safety. Specifically, the delineation of responsibilities between the industry and trade, health, agriculture , and environment sectors of the province still has many shortcomings. Some products, such as yeast (leaf yeast), fruit juices, and tonic wines, do not have clearly defined managing agencies, leading to overlapping or overlooked responsibilities in the management process.

This situation not only creates difficulties for regulatory agencies but also affects businesses in identifying the point of contact for carrying out administrative procedures. Therefore, regulations need to be reviewed and adjusted to clearly define responsibilities and avoid overlaps.

In the field of chemical management, a prominent issue is the regulation regarding certificates of eligibility for chemical storage operations. Although this regulation will only take effect from July 1, 2026, from January 17, 2026, applications for chemical production and trading licenses have already required businesses to have a warehouse rental contract with a unit holding this certificate.

In reality, no organization has yet been granted this type of certificate, leading to a situation where businesses cannot complete their applications if they need to rent warehouse space. The question is, during the transitional period before July 1, 2026, will it be possible to accept warehouse rental contracts from entities that have not yet been granted this certificate? This is a matter that requires specific guidance from the competent authority to avoid disruptions to production and business operations.

Another bottleneck is the regulation of safe distances in the production and storage of hazardous chemicals. Although the Government has issued guiding regulations, specific criteria for safe distances have yet to be issued. This makes it difficult for authorities to conduct on-site assessments of facilities and creates inconsistency in evaluating the conditions of businesses. The prompt issuance of technical standards or detailed guidelines is an urgent requirement to ensure safety and transparency in management.

A synchronized approach is needed to resolve the issue.

In the field of industrial promotion, many localities still face difficulties due to a lack of legal basis for policy implementation. Although the Government has expanded the scope and content of industrial promotion activities, the Ministry of Finance has not yet issued regulations on expenditure levels, leaving localities, including Lam Dong, without sufficient grounds to provide support to priority groups such as women, ethnic minorities, and handicraft artisans.

The delay in issuing financial guidelines is reducing the effectiveness of the policy and affecting the progress of rural industrial development programs.

Besides the aforementioned obstacles and shortcomings, the provincial industry and trade sector is currently facing many difficulties in areas such as: accreditation of chemical safety training, regulations on safe distances, and decentralization of import and export procedures…

The aforementioned difficulties highlight the urgent need to improve the system of guiding documents, especially during the transitional period when many new regulations come into effect. Delays or inconsistencies in issuing guidelines not only create difficulties for businesses but also affect the effectiveness of state management.

According to Mr. Tran Vu Ngoan, Deputy Director of the Department of Industry and Trade, to resolve these issues, relevant ministries and agencies need to promptly issue detailed guidance documents, unifying the understanding and application of the law. At the same time, they should strengthen coordination with localities to promptly handle emerging situations. Only when these legal "bottlenecks" are resolved comprehensively can the industry and trade sector operate smoothly, contributing to the socio-economic development of the locality.
