The National Assembly is submitting a proposal to amend the Constitution, suggesting the appointment of leaders when provinces are merged.

On the morning of May 7th, Vice Chairman of the National Assembly Nguyen Khac Dinh presented to the National Assembly a draft resolution amending and supplementing several articles of the 2013 Constitution.

Accordingly, based on the scope of amendments and additions to the Constitution as decided by the National Assembly, the Committee drafting amendments and additions to a number of articles of the 2013 Constitution has determined that the draft resolution amending and supplementing a number of articles of the 2013 Constitution consists of 2 articles.

Article 1 comprises eight clauses amending and supplementing certain provisions of the 2013 Constitution regarding the Vietnam Fatherland Front and socio- political organizations, administrative units, and local government organization. Article 2 comprises three clauses stipulating the effective date and transitional provisions.

The Central Committee of the Vietnam Fatherland Front has the right to submit draft laws and draft ordinances.

Regarding the Vietnam Fatherland Front and socio-political organizations (Articles 9 and 84), Mr. Dinh stated that to clarify the core role of the Vietnam Fatherland Front (VFF), emphasizing its position as the central organization of the national unity bloc, and ensuring the legal basis for the organizational structure of the VFF and socio-political organizations, he proposed amending and supplementing the regulations on the position, functions, organizational principles, and operation of the VFF in Article 9.

This is to ensure compliance with the new organizational model after the restructuring of political and social organizations under the Vietnam Fatherland Front.

At the same time, the regulations stipulate that the Central Committee of the Vietnam Fatherland Front has the right to submit draft laws and draft ordinances as stipulated in Clause 1, Article 84 of the 2013 Constitution, in order to align with the amendments and additions to Article 9 mentioned above.

Regarding the Vietnamese trade union (Article 10), Mr. Dinh stated that, based on a reasonable inheritance of the current provisions of the Constitution on the position and role of the trade union organization and ensuring consistency with the proposed amendments and additions to Article 9 of the 2013 Constitution, the Committee proposes amending and supplementing Article 10 as follows:

Affirming that the Vietnam Trade Union is a socio-political organization of the working class and laborers, directly under the Vietnam Fatherland Front.

At the same time, the role of the Vietnam Trade Union should be expanded to include representing workers at the national level in labor relations and international trade union relations, in order to align with the context of international economic integration.

Constitutional Amendment: Proposal to omit the term "local government level"

Regarding the organization of administrative units and some other contents concerning local government (in Chapter 9 of the Constitution), Mr. Dinh said that in implementing the Party's policy on streamlining the organizational structure of the political system, organizing local government at two levels, and ending the operation of district-level administrative units, the Committee proposed only a general provision on the demarcation of Vietnam's administrative units in Article 110.

This includes provinces, centrally-administered cities, and administrative units below the provincial and centrally-administered city levels, as well as special administrative- economic units established by the National Assembly.

The National Assembly shall prescribe the classification of administrative units below the provincial and centrally-administered city levels, as well as the procedures for establishing, dissolving, merging, dividing, and adjusting the boundaries of administrative units.

At the same time, the conclusions of the Central Committee, the Politburo, and the Secretariat on the organization of local governments at the provincial and commune levels with People's Councils and People's Committees were institutionalized.

It is proposed to amend and supplement Articles 111, 112, and 114 to stipulate that the local government organization consists of the People's Council and the People's Committee, without using the term "local government level".

Clause 2 of Article 115 does not stipulate that the chief justice of the people's court and the chief prosecutor of the people's procuracy are subject to answering questions from People's Council representatives, in order to be consistent with the nature and organizational model of local state agencies after the restructuring.

Proposal to regulate the designation of leadership positions during mergers.

Mr. Dinh stated that the committee proposed setting the effective date of the resolution as July 1st.

To promptly institutionalize the conclusions and directives of the Central Committee, the Politburo, and the Secretariat, the Committee proposes that the draft resolution include a provision officially declaring the termination of the operation of district-level administrative units and a transitional clause stipulating the appointment of positions in the People's Council, People's Committee, and heads and deputy heads of the National Assembly delegations when rearranging provincial and commune-level administrative units in 2025 and consolidating the organizational structure of the People's Council and People's Committee for the 2021-2026 term when there are no longer district-level administrative units.
