Submit to the National Assembly to amend the Constitution, propose to appoint leaders when merging provinces

Accordingly, based on the scope of amendments and supplements to the Constitution decided by the National Assembly, the Committee for drafting amendments and supplements to a number of articles of the 2013 Constitution determined that the draft resolution amending and supplementing a number of articles of the 2013 Constitution consists of 2 articles.

Article 1 includes 8 clauses amending and supplementing a number of provisions of the 2013 Constitution on the Vietnam Fatherland Front and socio- political organizations, administrative units and local government organizations. Article 2 includes 3 clauses regulating the effective date and transitional provisions.

The Central Committee of the Vietnam Fatherland Front has the right to submit draft laws and draft ordinances.

Regarding the Vietnam Fatherland Front and socio-political organizations (in articles 9 and 84), Mr. Dinh stated clearly to clarify the core role of the Vietnam Fatherland Front (VFF), emphasizing its position as the central organization of the great national unity bloc, ensuring the legal basis for the arrangement of the apparatus of the Vietnam Fatherland Front and socio-political organizations, and proposed to amend and supplement the regulations on the position, functions, principles of organization and operation of the Vietnam Fatherland Front in article 9.

This is to ensure compliance with the new organizational model after the arrangement of socio-political organizations under the Vietnam Fatherland Front.

At the same time, it is stipulated that the Central Committee of the Vietnam Fatherland Front has the right to submit draft laws and draft ordinances in Clause 1, Article 84 of the 2013 Constitution to agree with the content of the amendment and supplement to Article 9 mentioned above.

Regarding the Vietnam Trade Union (in Article 10), Mr. Dinh stated that on the basis of reasonable inheritance of the current provisions of the Constitution on the position and role of the Trade Union organization and ensuring consistency with the content of the proposed amendments and supplements in Article 9 of the 2013 Constitution, the Committee proposed to amend and supplement Article 10 in the following direction:

Affirming that Vietnam Trade Union is a political and social organization of the working class and laborers, directly under the Vietnam Fatherland Front.

At the same time, supplement the task of the Vietnam General Confederation of Labor as the representative of workers at the national level in labor relations and international relations on trade unions to suit the context of international economic integration.

Constitutional Amendment: Proposal to not use the term "local government level"

Regarding the organization of administrative units and some other contents on local government (in Chapter 9 of the Constitution), Mr. Dinh said that implementing the Party's policy on streamlining the apparatus of the political system, organizing two-level local government and ending the operation of district-level administrative units, the Committee proposed only general regulations on the demarcation of administrative units of Vietnam in Article 110.

Including provinces, centrally run cities and administrative units below provinces, centrally run cities, and special administrative- economic units established by the National Assembly.

The determination of types of administrative units below provinces and centrally run cities and the order and procedures for establishment, dissolution, merger, division of administrative units, and adjustment of administrative unit boundaries are prescribed by the National Assembly .

At the same time, institutionalize the conclusions of the Central Committee, the Politburo, and the Secretariat on the organization of local governments at the provincial and commune levels with People's Councils and People's Committees.

Propose to amend and supplement Articles 111, 112, 114 in the direction of regulating the organization of local government including People's Council and People's Committee, not using the term "local government level".

Do not stipulate that the chief justice of the people's court and the chief prosecutor of the people's procuracy are within the scope of subjects answering questions from People's Council delegates in Clause 2, Article 115 to be consistent with the nature and organizational model of local state agencies after the arrangement.

Proposed regulations on designating leadership positions during mergers

Mr. Dinh stated that the committee proposed to determine the effective date of the resolution as July 1.

In order to promptly institutionalize the conclusions and directions of the Central Committee, the Politburo, the Secretariat, and the Committee, it is recommended that the draft resolution should have an official provision declaring the end of the operation of district-level administrative units and a transitional provision regulating the appointment of positions of the People's Council, People's Committee, and the head and deputy head of the National Assembly delegation when arranging provincial and commune-level administrative units in 2025 and perfecting the organizational apparatus of the People's Council and People's Committee for the 2021-2026 term when there are no more district-level administrative units.
