
The Ministry of Home Affairs has issued Circular 04/2024/TT-BNV dated June 27, 2024, amending and supplementing several articles of Circular No. 13/2022/TT-BNV dated December 31, 2022, of the Minister of Home Affairs guiding the determination of the civil servant rank structure, which stipulates the civil servant rank ratio from August 15, 2024, as follows:
Determining the civil servant rank structure excludes officials and civil servants holding leadership and management positions. According to the circular, when determining the civil servant rank structure of administrative agencies and organizations, officials and civil servants holding leadership and management positions are not included.
During the period before the implementation of salary-based pay according to position and title as stipulated in Resolution No. 27-NQ/TW dated May 21, 2018, of the 7th Plenum of the 12th Central Committee on reforming salary policies for cadres, civil servants, public employees, armed forces personnel, and employees in enterprises, cadres and civil servants holding leadership and management positions may participate in examinations and be considered for promotion to a higher rank corresponding to the complexity of their leadership and management position, but this will not be included in the civil servant rank structure of the agency or organization.
The ratio of civil servant ranks in agencies, organizations, and units under or directly affiliated with ministries and ministerial-level agencies.
For departmental-level organizations and equivalents under or directly subordinate to ministries and ministerial-level agencies:
+ Senior specialist and equivalent positions: maximum 40%;
+ Senior specialist and equivalent positions: maximum 40%;
+ Specialist and equivalent positions, assistant and equivalent positions, staff and equivalent positions: percentage (%) of the remaining positions.
For organizations under or directly subordinate to the General Department:
+ For departmental-level organizations and equivalents under the General Department: Senior specialist and equivalent ranks: maximum 30%; Principal specialist and equivalent ranks: maximum 50%; Specialist and equivalent ranks, assistant and equivalent ranks, staff and equivalent ranks: percentage of the remaining ranks.
+ For organizations directly under the General Department and organized at the local level according to the vertical structure: Senior specialist and equivalent ranks: maximum 40%; Specialist and equivalent ranks, assistant and equivalent ranks, staff and equivalent ranks: percentage of the remaining ranks.
The ratio of civil servant positions in specialized agencies and administrative agencies and organizations under the Provincial People's Committee.
For specialized agencies and administrative organizations under the People's Committee of centrally-governed cities:
+ Senior specialist and equivalent positions: maximum 50%;
+ Specialist and equivalent positions, assistant and equivalent positions, staff and equivalent positions: percentage of remaining positions.
For specialized agencies and administrative organizations under the People's Committee of provinces directly under the Central Government:
+ Senior specialist and equivalent positions: maximum 40%; Specialist and equivalent positions, assistant and equivalent positions, staff and equivalent positions: percentage of the remaining positions.
The ratio of civil servant positions in specialized agencies and administrative agencies and organizations under the People's Committee at the district level.
Civil servants of specialized agencies and administrative organizations under the People's Committee at the district level hold the ranks of specialist and equivalent, assistant and equivalent, and staff and equivalent, in accordance with the standards and conditions of the job position.
The proportion of civil servants in other agencies and organizations.
For agencies and organizations established in accordance with Party regulations and laws, and allocated civil servant positions by competent authorities but not falling under the categories above, the head of the civil servant management agency shall decide to apply the percentage of civil servant ranks stipulated in the above categories in accordance with the functions, tasks, and scale of operation of the agency employing civil servants.
