There are still 2 positions that need attention.

The road project to the Ninh Phuoc commune administrative center has a total length of 5.1km. The contractor is a joint venture between Company 6.3 and Trung Trung Bo Company. The project was scheduled for completion between 2021 and 2024. However, the project is still facing land acquisition issues.

Mr. Nguyen Van Hoa, Chairman of the People's Committee of Nong Son District, said that the project is facing land clearance issues at two locations. The area at the beginning of the route cannot be cleared due to the house of Mr. Nguyen Van Long. This is a poor household; Mr. Long's wife suffers from a serious illness, and they have four children of school age. However, the land where the family lives is not residential land. Therefore, only compensation for assets on the land can be provided; resettlement is not possible. A resettlement plot, at current prices, costs approximately 400 million VND, which is beyond the family's means. The local authorities have made efforts to persuade and educate them for many years, but have yet to reach a consensus.

Furthermore, the project area includes land related to deforestation incidents that occurred in Ninh Phuoc commune. The forest status assessment has been completed, so the People's Committee is proposing a plan to use the current status assessment to hand over the land for project implementation. At the same time, the case will continue to be prosecuted according to the law. Waiting until the prosecution is completed before handing over the land to the project would take a very long time.

"Due to land acquisition issues, the investor has only handed over 90% of the land to Trung Trung Bo Joint Stock Company and 30% to 6.3 Joint Stock Company to implement the project," Mr. Nguyen Van Hoa informed.

Mr. Tran Phu Hoa, Director of Trung Trung Bo Joint Stock Company, stated that 90% of the land has been cleared, but construction is facing difficulties due to a large amount of excess soil, while the waste disposal site does not have sufficient capacity. Nong Son has planned three quarries to serve the project, one of which has a capacity of 30,000 m³ and is already full, while the other two have not yet been cleared. Therefore, to accelerate construction progress according to the phased construction plan, the excess soil must be dealt with promptly.

“The prolonged land clearance issues have led to escalating material and labor costs, causing significant difficulties for businesses. In reality, the inter-departmental price is already much lower than the actual price, and we earnestly hope the Provincial People's Committee will direct timely adjustments. If the Nong Son District People's Committee completes land clearance by the end of this year, the contractor commits to accelerating construction progress and completing the project in 2025,” said Mr. Tran Phu Hoa.

The site preparation must be completed by the end of 2024.

According to the Chairman of the People's Committee of Nong Son District, Nguyen Van Hoa, the entire project has a surplus of 125,000 of soil. After deducting 75,000 of decomposed soil, there are 65,000 remaining that must be disposed of. Meanwhile, the Ho Cai reservoir project is short of approximately 65,000 of soil. The People's Committee of Nong Son District has completed the relevant documents and procedures and submitted them to the Department of Natural Resources and Environment to request permission to use the surplus soil from the road project to the Ninh Phuoc commune administrative center to fill the Ho Cai reservoir. This is a solution to reduce the project's estimated cost and accelerate construction progress.

During a recent inspection of the project's construction progress, Vice Chairman of the Provincial People's Committee Tran Nam Hung criticized Nong Son's land clearance work. Mr. Hung stated that regarding the issues related to Mr. Nguyen Van Long's household, Nong Son needs to be flexible in its resettlement options. For example, they could consider changing the land use purpose of Mr. Long's family or arranging for them to live in a suitable location within the district.

In cases where households do not own any other land or housing in the district, it is advisable to agree on the policy of allowing them to defer payment of land use fees as stipulated in Article 26 of Government Decree No. 88/2024 dated July 15, 2024. The land in question was granted a land use certificate ("red book") but the debt is recorded, preventing any transactions with banks or sales. The debt will be repaid and cleared from the land use certificate when the family is financially able. During the process, the district needs to explain the situation to the people so they understand and agree.

“The People's Committee of Nong Son District should urgently approve the compensation, support, and resettlement plan, as a basis for persuading households to hand over the land in October 2024. At the same time, consider supporting Mr. Long's family with a solidarity house. If the household does not agree, the People's Committee of the district should urgently carry out the procedures for compulsory land acquisition to implement the project. And once compulsory acquisition is carried out, they will not be entitled to any support policies,” Mr. Hung noted.

Regarding the issues related to deforestation, Mr. Hung instructed the Department of Agriculture and Rural Development to urgently inspect and appraise the forest status assessment documents to prepare procedures for converting forest land use to construction land in accordance with regulations. The People's Committee of Nong Son district is to cooperate and provide all relevant documents and materials, especially videos and photographs of the entire forest status within the project area, to serve as a basis for assessing the status before construction and related tasks.

Along with completing land clearance in 2024, Vice Chairman of the Provincial People's Committee Tran Nam Hung requested the People's Committee of Nong Son district to direct the contractor to flexibly adjust the construction plan to accelerate the disbursement of the extended 2023 capital (approximately 5.6 billion VND) before December 31, 2024. At the same time, he assigned the Department of Transport to take the lead, in coordination with the Department of Planning and Investment and relevant units, to advise the Provincial People's Committee on considering and adjusting the project implementation time to December 2025. However, the People's Committee of Nong Son district needs to submit a report explaining and verifying the responsibilities of the relevant collectives and individuals, and obtain the consensus of the District Party Committee Standing Committee.
