The Ministry of National Defense recently received a petition from voters in An Giang province requesting research and submitting to the National Assembly to amend the 2015 Military Service Law in the direction of requiring citizens to graduate from high school and be admitted to universities. If you are in college, you must perform military service and your studies will be reserved.

After completing military service and being demobilized, you will continue to participate in the reserved study program.

Responding to this petition, the Ministry of National Defense said that Article 30 of the Law on Military Service (NVQS) regulates the age for active service.

Citizens who are 18 years old are called to enlist in the army. The age for conscription is from 18 years old to 25 years old. Citizens who are trained at the college or university level and have been temporarily postponed from being called up for military service will have to age until 27 years old.

For citizens who are students, the temporary postponement of military enlistment is stipulated in Article 41 of the Law - that is, studying at a general education institution; are being trained at a full-time university level at a higher education institution, or at a full-time college level at a vocational education institution during a training course of a training level.

Thus, the provisions of the 2015 Law on Military Personnel have created conditions for citizens to temporarily postpone military service to focus on studying during a training course of a training level.

In addition, the active service age of citizens subject to the above suspension has also been extended so that citizens have the opportunity to perform their sacred duty to the Fatherland, contributing to ensuring social justice. .

On the other hand, the Ministry of National Defense said, Resolution of the 13th Congress determines "Building a revolutionary, regular, elite, and gradually modern People's Army and People's Police, a number of military branches, military branches, force moving forward towards modernity.

One of the solutions to achieve this strategic orientation of the Party is to improve the quality of human resources, including non-commissioned officers and soldiers serving on active duty.

Therefore, recruiting and conscripting highly qualified soldiers, especially citizens with university or college degrees, is necessary and consistent with the requirements of building the Army in the new situation.

The Ministry of National Defense affirms that the regulations on the age of conscription and temporary postponement of conscription for citizens admitted to universities and colleges are appropriate.

Research more sanctions to handle evasion of legal personnel

As for voters in Hung Yen province, there are still some situations where citizens of the age group carry out NVQS but avoid it in many ways. Voters pointed out many forms such as: going to domestic schools, studying abroad, traveling, exporting labor... when returning to the locality, the military age will expire, causing difficulties in calling citizens to join the army. .

Responding to these two recommendations, the Ministry of National Defense said that the process of implementing the Law on Human Resources has revealed a number of problems, inadequacies and difficulties.

Registration and management of civil rights for citizens, especially students after completing college or university; citizens leave their places of residence; Citizens go to study and work abroad. But there is a lack of management sanctions and has not been thoroughly handled. This leads to a lack of citizens willing to enlist, creating a loophole for some citizens to take advantage of and avoid performing military service, causing bad public opinion.

In addition, the sanctions prescribed in the 2015 Law on Human Resources do not fully cover violations, so the implementation process at the local level remains difficult and problematic in handling administrative violations and handling violations. criminal acts.
