Commenting on the proposal to stop the development of the draft Decree on connecting and sharing information under the National Single Window Mechanism drafted by the Customs Department ( Ministry of Finance ), the Vietnam Federation of Commerce and Industry (VCCI) raised two main concerns about the proposal to stop the development of the decree and the alternative plan.
Firstly, according to VCCI, the Ministry of Finance believes that stopping the development of the Decree will have "no impact" because it does not stipulate additional administrative procedures or obligations for people and businesses. However, VCCI points out that this assessment has overlooked an important aspect.
Specifically, the core objective of connecting and sharing information through the National Single Window Portal is to prevent businesses from having to repeatedly provide information and documents that state agencies already have or can exploit themselves from the common database. This is a practical benefit, helping to reduce procedural burdens and compliance costs.
Therefore, stopping the development of the Decree may affect this goal. VCCI requested the Ministry of Finance to explain more clearly whether the process of implementing administrative procedures of enterprises on the National Single Window Portal is affected from this perspective or not.
Second, the alternative needs to be more convincing. The Ministry of Finance proposed that the provisions in the Data Law 2024 and the Electronic Transaction Law 2023 could replace the issuance of a separate Decree. Regarding the issue of information sharing responsibilities, the Ministry proposed that only one directive document is needed to overcome the situation of ministries and branches delaying and causing difficulties.
However, VCCI believes that this proposal is not convincing enough. Although the new laws have created a legal corridor, in reality, connecting and sharing data still has many problems.
To make the alternative more reasonable, VCCI recommends that the Ministry of Finance should supplement a detailed report on the current status of connection and information sharing in the fields of import, export and immigration. The report should clearly state the specific difficulties and obstacles and the practical basis to prove that a directive document is effective enough, instead of needing a Decree with higher legal status to thoroughly resolve the situation of "delay and fragmentation" in data sharing.
The above opinions of VCCI aim to ensure that any decision related to the National Single Window Mechanism must aim at the ultimate goal of simplifying procedures and creating maximum convenience for the operations of businesses and people.
VCCI hopes that the drafting agency will carefully consider the comments to edit and complete the proposal before submitting it to the Prime Minister .
