Deadline for promulgating legal documents detailing and guiding the implementation of Law 68/2025/QH15

(Chinhphu.vn) - Deputy Prime Minister Ho Duc Phoc requested that all decrees guiding the implementation of the Law on Management and Investment of State Capital in Enterprises (Law No. 68/2025/QH15) must be issued before December 15, 2025.

Promptly issue decrees detailing and guiding Law 68/2025/QH15 to remove difficulties and obstacles, creating motivation for business development.

On the afternoon of September 10, Deputy Prime Minister Ho Duc Phoc met with ministries, branches and enterprises on the plan to implement the Law on Management and Investment of State Capital in Enterprises (Law No. 68/2025/QH15).

The report of the Ministry of Finance clearly stated the development of a plan to implement Law 68/2025/QH15 to specifically determine the content of work, progress, completion deadline, assignment and responsibilities of relevant agencies and organizations in organizing the implementation of the law to ensure timeliness, comprehensiveness, unity, synchronization, effectiveness and efficiency.

Determine the responsibilities and coordination mechanisms among ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and cities in implementing the law nationwide.

Raising awareness of responsibility of all levels, sectors, provincial People's Committees and enterprises in implementing the law and legal documents detailing the law.

The report of the Ministry of Finance proposed contents on organizing propaganda, dissemination and education of laws on management and investment of state capital in enterprises; compiling documents serving the dissemination of theories and legal documents detailing and guiding implementation.

Regarding the drafting of legal documents detailing the law, the report said: there are 03 Decrees assigned to the Ministry of Finance to preside over and 02 Decrees assigned to the Ministry of Home Affairs to preside over.

The Ministry of Finance has submitted to the Government 03 draft Decrees detailing Law 68/2025/QH15, including: Decree regulating the supervision, inspection, and evaluation of the effectiveness of investment activities and management of state capital in enterprises; Decree regulating a number of contents on investment and management of state capital in enterprises; Decree on restructuring state capital in enterprises.

Regarding the two Decrees assigned to the Ministry of Home Affairs, the Ministry of Home Affairs will also submit to the Government a draft Decree on Management of title holders, positions and representatives of state capital in enterprises and a Decree on salaries, remunerations and bonuses of direct owners' representatives, representatives of state capital and controllers in enterprises according to regulations.

The report of the Ministry of Finance also mentioned the development of documents guiding the implementation of the law (including Decrees regulating the operating mechanism and financial management mechanism for enterprises in a number of specific fields as prescribed in Clause 2, Article 35 of Law 68/2025 chaired by the Ministry of Finance); organizing inspections of the implementation of the law and legal documents detailing and guiding the implementation; funding and implementation organization.

At the meeting, after listening to the report of the Ministry of Finance, opinions of the Government Office, the Ministry of Justice, leaders of enterprises (Viettel, PVN, TKV, EVN, VNR, SCIC) and representatives of the Ministry of Home Affairs, Ministry of National Defense, Ministry of Industry and Trade gave comments on the contents related to the plan to implement the law; financial mechanism; operating mechanism for state-owned enterprises in some specific fields.

Business representatives highly agreed with the proposed content in the draft Decrees detailing Law 68/2025. Believing that the promulgation of Law 68 has resolved and removed many difficulties, businesses expect that the decrees detailing and guiding the implementation of Law 68 will soon be promulgated, creating enough operating space, with mechanisms suitable for specific fields and industries of operation so that businesses have more motivation to develop strongly and go further in the coming time.

Five decrees detailing Law 68/2025/QH15 must be completed before October 30.

Concluding the meeting, Deputy Prime Minister Ho Duc Phoc requested the agency in charge of drafting detailed decrees and decrees guiding the implementation of Law 68 to make greater efforts to soon complete assigned tasks, facilitate business operations, and contribute to ensuring the set growth target.

Specifically, for the 05 decrees detailing Law 68/2025/QH15, Deputy Prime Minister Ho Duc Phoc requested the Ministry of Finance to complete the draft and submit to the Government 03 assigned Decrees before September 30; the Ministry of Home Affairs to complete and submit 02 draft decrees assigned before October 30.

Regarding the plan to implement Law 68/2025, the Deputy Prime Minister requested the Ministry of Finance to absorb opinions from ministries, branches and enterprises at the meeting, complete the draft decision and submit it to the Prime Minister before September 15.

Giving specific comments on the drafting of decrees guiding Law 68/2025/QH15 (decree on special regimes for credit institutions, foreign bank branches; management of lottery enterprises; Securities Depository and Clearing), Deputy Prime Minister Ho Duc Phoc requested the Ministry of Finance to complete it before December 15, 2025.

Regarding the decrees on the operating and financial mechanisms of state-owned corporations and groups, Deputy Prime Minister Ho Duc Phoc agreed with the proposal of enterprises to develop separate decrees suitable to the characteristics of each corporation and group.

Deputy Prime Minister Ho Duc Phoc requested corporations and general corporations to closely coordinate with the Ministry of Finance to speed up the progress of drafting a decree on operational and financial mechanisms; ensuring that all tasks and mechanisms are "sweeped" and each problem is solved at its root, in accordance with the characteristics of each corporation and general corporation.

Deputy Prime Minister Ho Duc Phoc emphasized that "the faster we do it, the sooner it will be issued, reducing difficulties for businesses."

Deputy Prime Minister Ho Duc Phoc suggested that the Ministry of Finance take the lead; the Ministry of Justice support the Ministry of Finance, the Ministry of Home Affairs and businesses to start "working early, issuing early".

We must strive to issue all decrees guiding the implementation of Law 68/2025 before December 15 for implementation, "time will not wait for us anymore", Deputy Prime Minister Ho Duc Phoc emphasized./.
