I am a student at a public university, and my father is a military officer receiving a regular allowance due to an occupational disease. I would like to ask if I am eligible as the child of a military officer with an occupational disease, entitled to a 50% tuition fee reduction under Decree No. 81/2021/ND-CP? What regulations are used to determine eligibility for the officials, civil servants, and public employees mentioned in point a, clause 2, Article 16 of Decree No. 81/2021/ND-CP? On September 3, 2025, the Government issued Decree No. 238/2025/ND-CP replacing Decree No. 81/2021/ND-CP dated August 27, 2021, which regulates the mechanism for collecting and managing tuition fees for educational institutions within the national education system and policies on tuition fee exemption and reduction, support for learning costs; and service prices in the field of education and training.

Accordingly, Clause 2, Article 16 of Decree No. 238/2025/ND-CP stipulates that the subjects eligible for a 50% tuition fee reduction include: Students in vocational education institutions and higher education institutions whose father or mother suffered a work-related accident or contracted an occupational disease and are receiving regular allowances.

In your case, it is necessary to refer to the provisions of Clause 2, Article 16 of Decree No. 238/2025/ND-CP to consider whether the student's father receives regular financial assistance, in which case the student is eligible for a 50% tuition fee reduction.

Regarding the determination of eligible officials, civil servants, public employees, and workers who suffer work-related accidents or occupational diseases and are entitled to regular allowances, Clause 3, Article 18 of Decree No. 238/2025/ND-CP, which stipulates the procedures and process for tuition fee exemption and reduction in public vocational and higher education institutions, requires a Decision on monthly allowance entitlement of the father or mother who suffered a work-related accident or occupational disease, issued by the Social Insurance agency, applicable to the subjects specified in Clause 2, Article 16 of Decree No. 238/2025/ND-CP.
