The United States issued the final conclusion of the administrative review of some steel pipe products imported from Vietnam.

Recently, the United States issued the final conclusion on the administrative review of anti-circumvention (CLT) of antidumping (AD) and countervailing duty (CVD) on rectangular steel pipe products that the United States is applying to China (case codes: A-570-914 and C-570-915). The above review was initiated by the US Department of Commerce (DOC) on October 18, 2023, based on the request of the defendant enterprise for the period 2022 - 2023.

On September 13, 2024, DOC issued a Preliminary Conclusion of the case, confirming that the sole Vietnamese respondent in the case used only hot-rolled materials from Vietnam to produce rectangular steel pipe products exported to the United States during the review period. DOC believes that because the enterprise maintains invoices and records of purchasing hot-rolled steel materials and is able to trace the origin of the materials, DOC confirms that this enterprise is eligible to participate in the mechanism for certifying that it does not use hot-rolled steel (HRS) originating from China to be exempted from the application of the measure.

The final conclusion remains the same as the preliminary conclusion. This is a positive result for Vietnamese enterprises because previously, in August 2023, in the Final Conclusion of the original CLT investigation case against Vietnam, DOC concluded that the above enterprise was not eligible to participate in the certification mechanism due to its failure to fully cooperate with the investigating agency.

This shows that Vietnamese enterprises may have the opportunity to continue participating in the US certification mechanism through compliance and cooperation, fully demonstrating to the investigating agency in the reviews to continue to maintain exports to the US.

Some information about the CLT investigation

On August 4, 2022, the US Department of Commerce (DOC) initiated an investigation into evasion of trade defense duties on rectangular steel pipes (Light-Walled Rectangular Pipe and Tube) imported from Vietnam, alleging that Vietnam imported hot-rolled steel (HRS) - the main raw material for producing steel pipes - from China, Taiwan - China, then processed and simply processed into steel pipes and exported to the United States to evade the corresponding anti-dumping (CBPG) and countervailing (CTC) duties that the United States is applying to China, Taiwan - China.
