Plan for the implementation of the Extradition Law

On November 26, 2025, at the 10th Session of the 15th National Assembly, the Extradition Law was passed (effective from July 1, 2026). To ensure the timely, unified, and effective implementation of the Extradition Law, the Prime Minister issued a Plan for its implementation. This plan aims to specifically define the work content, deadlines, progress, and responsibilities of ministries, ministerial-level agencies, government agencies, People's Committees of provinces and cities, the Supreme People's Court, the Supreme People's Procuracy , and other relevant agencies and organizations in implementing the Law, ensuring timeliness, consistency, uniformity, effectiveness, and efficiency.

Simultaneously, it is necessary to identify effective coordination mechanisms between ministries, ministerial-level agencies, and government agencies with the Supreme People's Court , the Supreme People's Procuratorate, and the Central Committee of the Vietnam Fatherland Front in implementing the Law nationwide and raising awareness and responsibility of agencies, organizations, and officials involved in extradition work, as well as the awareness of the people.

The plan focuses on reviewing and systematizing legal documents; developing legal documents that detail the contents assigned in the Law; organizing propaganda, dissemination, and legal education on extradition; reviewing and verifying offenders; and organizing the implementation of decisions on receiving and transferring extradited persons...

In this process, the Ministry of Public Security will take the lead, coordinating with relevant ministries and agencies and the People's Committees of provinces and cities to review legal documents related to the Law, and compile a list of documents that need to be amended, supplemented, replaced, or repealed to conform with the Law. The deadline for completion is before May 1, 2026.

The Ministry of Public Security, in coordination with relevant agencies, will develop a Government Decree detailing certain provisions of the Law; a Government Decree stipulating the costs of implementation and funding for extradition, the transfer of persons serving prison sentences, and mutual legal assistance in criminal matters;... and submit them to the Government before April 30, 2026.

Relevant ministries and agencies, according to their functions and duties, will implement the dissemination of extradition laws through mass media and social media platforms; and compile materials to disseminate the Law and other detailed legal documents.

Organize training sessions on the Law and detailed legal regulations to enhance responsibility and unify understanding among officials involved in criminal investigation, management of criminal sentence execution, extradition, international cooperation, legal teaching and research, and the general public.

From July 1, 2026, the Ministry of Public Security, in coordination with relevant ministries and agencies, will review and verify the identities of Vietnamese criminals who have fled abroad and foreign criminals who are hiding in Vietnam; provide guidance on preparing, verifying, and sending extradition requests from Vietnam to foreign countries, and on preparing, receiving, and verifying extradition requests from foreign countries sent to Vietnam; organize the implementation of decisions on receiving and transferring extradited persons; and organize inspections, supervision, and monitoring of the implementation of the Law and detailed legal documents...
