At its 5th session, the Da Nang City People's Council passed Resolution No. 41 dated December 11, 2025 (hereinafter referred to as Resolution 41) stipulating a number of social assistance policies in Da Nang City, effective from January 1, 2026.
Resolution 41 was issued to replace related resolutions previously issued by the Da Nang City People's Council and the Quang Nam Provincial People's Council (which expire on January 1, 2026). These include Resolution No. 29 dated October 24, 2024, of the Quang Nam Provincial People's Council (referred to as Resolution 29), which stipulates certain levels of social assistance for social protection beneficiaries and other disadvantaged groups in the province.
The issuance of Resolution 41 is absolutely necessary, in accordance with legal regulations and the practical situation of the locality, aiming to ensure uniformity, consistency, and inclusiveness in the implementation of social assistance policies after the merger of Quang Nam province and Da Nang city.
However, due to the lack of specific guidance from the City People's Committee on how to implement Resolution No. 41, many localities have issued notices temporarily suspending social assistance policies for beneficiaries under Resolution No. 29 from January 1, 2026, until further notice. This has caused concern among policy beneficiaries, especially those receiving health insurance benefits.
For example, immediately after the "Thang Dien Commune Information" Fanpage posted Announcement No. 189 dated December 31, 2025, from the People's Committee of Thang Dien Commune regarding the temporary suspension of policies and benefits (health insurance, monthly allowances) for beneficiaries under Resolution No. 29, many comments expressed concern and anxiety. The majority of people believed that the suspension should have been announced earlier to avoid being caught off guard, especially regarding health insurance.
Regarding this matter, Ms. Nguyen Pham Minh Tri, Vice Chairman of the People's Committee of Thang Dien commune, confirmed that the locality had issued the aforementioned notice, aiming to inform people with serious illnesses to proactively plan for personal health insurance in the short term so that medical examinations and treatment would not be interrupted while waiting for guidance documents on implementing the new resolution from the city.
Explaining the reason further, Ms. Tri said that although Resolution 29 expired on January 1, 2026, the City People's Committee and the Department of Health have yet to issue guiding documents for the implementation of Resolution 41. This leaves the grassroots level without a legal basis for application.
"Given these shortcomings, and without guidance from higher authorities, the commune has no basis to implement Resolution 41. As soon as a specific document is issued, the locality will immediately apply it to ensure the rights of the people," Ms. Tri said.
Avoid disrupting the system and policies.
Similarly to Thang Dien commune, on January 5, 2026, the People's Committee of Nui Thanh commune also issued a notice temporarily suspending the implementation of regimes and policies for those receiving subsidies under Resolution No. 29 from January 1, 2026.
The local authorities stated that immediately after the Da Nang City People's Committee issues the guiding document for the implementation of Resolution No. 41, the Nui Thanh Commune People's Committee will publicly announce and promptly organize the implementation, ensuring the rights of eligible individuals are protected according to the new regulations.
Following reports that some localities have issued notices temporarily suspending the implementation of policies and benefits for beneficiaries under Resolution No. 29 from January 1, 2026, the Da Nang City Electronic Information Portal announced on January 7, 2026: The city has no intention of suspending these policies. Social assistance in the city will continue to be provided fully, promptly, and in accordance with Resolution No. 41 dated December 11, 2025, effective from January 1, 2026.
Regarding this matter, Ms. Doan Thi Hoai Nhi, Deputy Director of the Department of Health, stated: There is no suspension or interruption of the implementation of social policies and regulations. Resolution No. 41 (effective from January 1, 2026) does not stipulate new policies but is essentially an integration of previous resolutions. Therefore, eligible individuals will be immediately included in the transition, while newly emerging individuals will be considered later. Resolution 41 clearly outlines the groups eligible for transition, so localities need to implement it normally. In particular, regarding health insurance cards, continuity must be ensured to avoid affecting the rights of citizens.
Regarding the Department of Health's request for feedback from departments, agencies, and commune/ward People's Committees on the draft document of the City People's Committee concerning the implementation of Resolution No. 41, Ms. Doan Thi Hoai Nhi stated that this is a normal operational procedure. Issuing a guiding document is necessary to define long-term coordination responsibilities between units; however, policy implementation at the local level must continue as normal, and the rights of citizens should not be interrupted while waiting for the document.
