Accordingly, the Ho Chi Minh City Department of Education and Training proposed a plan for the People's Committees at the commune level to perform the state management function for education in public schools from preschool, primary, and secondary levels. Based on this, specific functions and tasks will be assigned to the People's Committees at the commune level, and the Department of Education and Training will be responsible for sectoral management. This will be done to gather official feedback before submitting the plan to the Department of Internal Affairs, which will then present the overall proposal to the Ho Chi Minh City People's Committee, as per regulations.

According to statistics from the Ho Chi Minh City Department of Education and Training, the total number of public schools from preschool to junior high school is approximately 1,255.

When the Department of Education and Training is no longer in place, the commune-level government will manage public kindergartens, primary schools, and secondary schools according to the following guidelines:

  • Develop plans, programs, schemes, and projects for educational development. Ensure that all necessary conditions regarding finance, assets, facilities, and land are met as required by regulations.
  • To make decisions on land use planning, land use plans, and education development plans within the scope of delegated management authority.
  • Manage and organize the effective use of offices, assets, work equipment, and allocated state budget within the locality in accordance with the law.
  • Investing in or participating in the construction of preschools, primary schools, secondary schools, and multi-level schools, including the highest level being secondary school, as prescribed; coordinating with relevant units to advise competent authorities on the construction of national standard schools and land use plans for educational facilities in the area.
  • Strengthen policies on the socialization of education and mobilize resources to develop education in the area.
  • To prepare the education budget, decide on the allocation and assignment of budget estimates to educational institutions upon approval by competent authorities; to approve and announce annual budget settlements and compile budget settlement reports of educational institutions within the assigned authority; to submit to competent authorities for guidance and inspection on the allocation and use of state budget and other legitimate financial sources for educational institutions in the area according to regulations.
  • Directly manage the organization and personnel of community learning centers (directing the implementation of the utilization, evaluation, training, and development of staff, and the application of policies for the community learning center staff under management according to regulations).
  • Authorize the establishment, merger, division, separation, suspension of educational activities, and dissolution of independent preschool groups and kindergartens in accordance with regulations; inspect the conditions ensuring the quality of care and education of independent preschool groups and kindergartens in the area.
  • Directing and guiding the enrollment process for primary and secondary education within its jurisdiction; implementing universal education, compulsory education, literacy programs, building national standard schools, and developing a learning society in the area…

The Department of Education and Training presides over or delegates the recruitment of teachers for public preschools, primary schools, and secondary schools.

Under this arrangement, the Department of Education and Training will be responsible for advising and submitting to the competent authority decisions on job positions and staffing levels for education management agencies; and advising and submitting to the competent authority decisions on job positions and the total number of employees in public schools in accordance with the law.

Preside over or delegate the recruitment, employment, appointment, change of professional titles, training, professional development, and evaluation of teachers, educational administrators, and staff in public educational institutions according to authority and regulations; preside over the implementation of training and professional development for teachers and administrators in non-public educational institutions in the province according to regulations.

Ensuring sufficient staffing of education management officials, a sufficient number of employees according to the approved job position plan, meeting the conditions for ensuring educational quality, being accountable for educational activities and quality, managing the team of officials, employees, workers and students, and implementing educational development policies within the scope of management.

At the same time, the Department of Education and Training will be responsible for deciding on the recognition, appointment, dismissal, transfer, change of job positions, rewards, and disciplinary actions for the heads and deputy heads of public schools...

On April 24th, the Ho Chi Minh City People's Committee issued a directive to the Department of Education and Training and other departments and agencies regarding the reorganization of public schools under the People's Committees of districts, counties, and Thu Duc City. The People's Committee requested the Department of Education and Training and local authorities to submit their plans for reorganizing public schools to the Department of Internal Affairs, which will then present the overall plan to the Ho Chi Minh City People's Committee for consideration no later than April 28th.
