3-step process to apply for red book online

In April 2023, the Government issued Decree 10, amending and supplementing a number of articles of the Decrees guiding the implementation of the Land Law.

In this Decree, the State management agency allows people to submit applications for land use right certificates (red books) online through the National Public Service Portal, instead of going directly to the Land Registration Offices as before. This regulation is applied from May 20, 2023.

To apply for a red book online, people can follow 3 steps.

First, people must register for red book issuance online at the National Public Service Portal.

Second, the agency receiving and processing the dossier is responsible for implementing administrative procedures on land according to current laws.

In case there is an incident in the dossier that needs to be checked, verified, clarified, or due to other reasons, the dossier processing result cannot be returned within the prescribed time, the dossier receiving and procedure processing agency shall send a written notice or via the Public Service Portal, via SMS to the requester, stating the reason.

Third, return the results. After receiving and processing the application, the receiving agency will return the results of the red book issuance procedure at the agency's headquarters or via postal service, or at the requested location.

Regarding fees, land users and owners of assets attached to land are responsible for fulfilling their financial obligations as prescribed by law by paying in cash directly or paying online through the payment function on the Public Service Portal.

The fee for issuing a red book is determined by the provincial People's Council, so it may vary from local to local. The fee for issuing a red book nationwide currently ranges from 80,000 - 1,200,000 VND.

After the land user has fulfilled his/her financial obligations, the receiving agency or the agency handling the application shall notify the applicant to carry out the administrative procedure to submit the original of the issued Certificate and other relevant documents as prescribed.

Land users and owners of assets attached to land requesting to carry out administrative procedures on land (requesting to issue red books online) are responsible before the law for the accuracy and honesty of the declared content and documents in the submitted dossier.

The receiving agency or the agency handling the application shall notify the applicant to carry out the administrative procedure to submit the original of the issued Certificate and the required documents after the land user has fulfilled his/her financial obligations.

The receiving agency is responsible for checking the completeness of the application components.

The agency handling administrative procedures on land is responsible for implementing the correct authority and time as prescribed by law, and is not responsible for the contents of documents and papers in the file that have been previously approved, appraised, ratified or resolved by other competent agencies or individuals.

At the same time, the connection, data sharing, and electronic interconnection between agencies to carry out administrative procedure settlement and payment of financial obligations of the person requesting the procedure shall comply with the provisions of law on carrying out administrative procedures in the electronic environment and the law on implementing the one-stop and one-stop mechanism.
