Strengthening the protection of children's privacy

The Department of Maternal and Child Health (Ministry of Health) has just issued Official Dispatch No. 305/BMTE-BV dated April 25, 2025 to the Department of Press, Department of Radio, Television and Electronic Information on strengthening the protection of children's privacy.

The document stated: In recent times, a number of electronic newspapers and social media accounts have posted articles and clips reflecting a number of cases of violence and child abuse. This information has contributed to supporting authorities and competent agencies to promptly handle acts of violence and child abuse in particular and acts of violating children's rights in general.

However, some electronic newspapers and social networking sites, when posting information, violated regulations on protecting children's privacy as prescribed in Article 21 and Clause 2, Article 54 of the Law on Children and Article 33 of Decree No. 56/2017/ND-CP dated May 9, 2017 of the Government detailing a number of articles of the Law on Children.

To ensure children's rights and protect children's privacy, the Department of Mothers and Children requests the Department of Press, the Department of Radio, Television and Electronic Information to direct relevant agencies, organizations and individuals to comply with legal regulations and take measures to handle agencies, organizations and individuals who violate regulations on protecting children's privacy.

Article 21. Law on Children: Right to privacy : (1). Children have the inviolable right to privacy, personal privacy and family privacy for the best interests of children. (2). Children are protected by law in their honor, dignity, reputation, confidentiality of correspondence, telephone, telegram and other forms of private information exchange; are protected and prevented from unlawful interference with private information.

Clause 2, Article 54 of the Law on Children. Responsibility to protect children in the online environment: Agencies, organizations and individuals managing and providing information and communication products and services and organizing activities in the online environment must take measures to ensure the safety and privacy of children in accordance with the provisions of law.

Article 33 of Decree No. 56/2017/ND-CP dated May 9, 2017 of the Government detailing a number of articles of the Law on Children: Confidential information on private life and personal secrets of children is information about: name, age; personal identification characteristics; information on health status and privacy recorded in medical records; personal images; information on family members, child caretakers; personal property; telephone number; personal mailing address; address, information on residence, hometown; address, information on school, class, learning results and friends of children; information on services provided to individual children.
