Unifying procedures and forms for collecting public opinions on administrative unit mergers and acquisitions

In Official Dispatch No. 03/CV-BCĐ on the orientation of a number of tasks of arranging administrative units and organizing two-level local governments, the Steering Committee for arranging administrative units at all levels and building a model of organizing two-level local governments clearly stated that it is necessary to organize to collect people's opinions on the Project on Arranging administrative units at provincial and commune levels.

In order to meet the progress of arranging provincial and commune-level administrative units in 2025 as required by the Politburo and the Secretariat in Conclusion No. 137-KL/TW and to have flexibility and initiative for localities to organize implementation in accordance with reality, Resolution No. 74/NQ-CP stipulates: "The provincial People's Committee organizes to collect opinions from voters representing households in the provincial-level administrative units to implement the merger (for the policy of arranging provincial-level administrative units), in commune-level administrative units directly affected (for the policy of arranging commune-level administrative units)."

The Provincial People's Committee decides on the form, order, procedures, and time limit for collecting opinions in accordance with the practical conditions of the locality, ensuring the progress of submitting the dossier of the Administrative Unit Arrangement Project as required in Conclusion No. 137-KL/TW and Resolution No. 74/NQ-CP.

To ensure consistency in content, order and procedures for collecting opinions from local people, the Steering Committee for the arrangement of administrative units at all levels and the construction of a 2-level local government organization model recommends that the Provincial People's Committee can choose the form of distributing opinion ballots (according to the form in Official Dispatch No. 03/CV-BCĐ) or choose other suitable forms such as collecting votes via electronic information pages, meetings of household representatives at administrative units at commune, village and residential group levels to vote...

Organizing public consultation on the policy of rearranging commune-level administrative units can be carried out at the same time as organizing public consultation on the policy of rearranging provincial-level administrative units.

Regarding the agency in charge of developing the Project on Reorganizing Provincial-level Administrative Units and the agency responsible for organizing the collection of public opinions, the Steering Committee recommends that the Standing Committee of the Provincial Party Committee and the City Party Committee (where the political-administrative center is selected) preside over and coordinate with the Standing Committee of the Provincial Party Committee at the same level to merge and develop the Project on Reorganizing Provincial-level Administrative Units.

Regarding the organization of public opinion collection in any locality, the Standing Committee of the Provincial Party Committee or City Party Committee of that locality shall direct the organization of public opinion collection.

Article 10, Clause 3 of the Law on Organization of Local Government 2025 stipulates: "Projects to establish, dissolve, merge, divide administrative units, adjust boundaries and rename administrative units must be consulted with people in commune-level administrative units directly affected.

The provincial People's Committee is responsible for organizing the collection of public opinions on the policy of establishing, dissolving, merging, dividing administrative units, adjusting boundaries and renaming administrative units in appropriate forms according to Government regulations."
