Summary of Resolution 16-NQ/TU on the management of coal and mineral resources

On August 21st, the Provincial Party Committee held a conference to summarize the five-year implementation of Resolution 16-NQ/TU dated May 9, 2019, of the Provincial Party Committee on strengthening the Party's leadership over the management of coal and mineral resources in the province. Attending and presiding over the conference were comrades Trinh Thi Minh Thanh, Standing Deputy Secretary of the Provincial Party Committee; and Cao Tuong Huy, Deputy Secretary of the Provincial Party Committee and Chairman of the Provincial People's Committee. Also present were leaders of the Vietnam Coal and Mineral Industry Group; the Northeast Corporation; the Quang Ninh Coal Party Committee; and leaders of various departments, agencies, and localities in the province.

The reports and opinions at the conference unanimously agreed that, in the spirit of continuing to inherit and promote Resolution No. 12-NQ/TU dated January 12, 2014, after 5 years of implementing Resolution No. 16-NQ/TU dated May 9, 2019 of the Provincial Party Committee, significant progress has been made, creating a positive shift in awareness among state management agencies, the coal industry, and mineral-related businesses in the management, exploitation, transportation, processing, and trading of minerals, as well as the protection of resources and the environment. The responsibility and role of leaders in mineral resource management have been emphasized and enhanced. Inspection, supervision, auditing, detection, investigation, prosecution, and adjudication of cases related to the mineral resource sector have been strengthened. Coordination among local authorities in detecting and handling cases with signs of criminal activity in the field of coal and mineral resources is carried out regularly, proactively, effectively, and with resolute and strict handling of violations. To date, the entire province has established and effectively operated a mechanism for accountability that is specific, clearly defines responsibilities, and emphasizes the role of Party committees and their leaders; continues to effectively control the situation and prevent the formation of hotspots for illegal coal and mineral exploitation, transportation, processing, and trading; strengthens control, detection, and strict handling of violations; and strictly manages coal ports and transportation routes in the area, essentially eliminating illegal mining and transportation activities. For other minerals, management has been strengthened, with adjustments to planning to ensure sustainability; close monitoring of mining activities at quarries for stone, sand, clay, and land leveling ensures compliance with regulations; and socio-economic development projects involving natural resources and minerals are strictly controlled. Coal and mineral mining units uphold their responsibility in managing resources within their assigned mining boundaries, while actively coordinating with local authorities in inspecting and handling violations in accordance with the law.

Concluding the conference, Comrade Trinh Thi Minh Thanh, Permanent Deputy Secretary of the Provincial Party Committee, emphasized: The achievements in implementing Resolution 16-NQ/TU are the result of the efforts and decisive involvement of the entire political system, and especially the coal industry. Over the past period, the coal industry has always been a partner with the province in promoting economic development, maintaining stability in production and business activities, ensuring social welfare, security and order, and improving environmental protection in the area.

Looking ahead, the management of natural resources and minerals in the province is expected to face many difficulties and challenges, with potential for complexities and the possibility of violations, misconduct, corruption, and waste in the field of natural resources, coal, and minerals. Therefore, to further strengthen the Party's leadership over the management of coal and mineral resources in the province, the Provincial Party Committee unanimously agreed to issue a new resolution to replace Resolution 16. The Standing Deputy Secretary of the Provincial Party Committee assigned the Party Committee of the Provincial People's Committee to direct the Provincial People's Committee to research and advise on the development of a project, submission, and draft resolution to replace Resolution No. 16-NQ/TU; and assigned the Provincial Party Committee's Internal Affairs Department as the lead unit to appraise the content of the project and draft resolution for submission to the Provincial Party Standing Committee and the Provincial Party Committee, ensuring compliance with regulations and completion before the year-end meeting of the Provincial Party Committee in November 2024.

During the drafting process of the new resolution, it is necessary to closely adhere to the practical situation of the locality, newly enacted legal regulations such as the Land Law, the Investment Law, the Mineral Law, and approved planning documents. At the same time, strengthen the fight against corruption and negative practices in the field of natural resources and minerals. Promptly address existing shortcomings, limitations, obstacles, difficulties, and inadequacies related to management in the field of natural resources and minerals.

While awaiting the issuance of the new resolution, the Standing Deputy Secretary of the Provincial Party Committee requested that all Party committees, organizations, governments, agencies, units, and localities continue to review and seriously, synchronously, and effectively implement the targets, objectives, tasks, and solutions already outlined in Resolution No. 16, the conclusions of the Provincial Party Committee, and the contents agreed upon at the conference and concretized in the written conclusions of the Provincial Party Committee. In particular, the management of natural resources and minerals must be identified as a crucial political task for the entire political system. Solutions must be implemented synchronously and decisively to achieve sustainable and transparent mineral management, resolving obstacles and difficulties related to procedures; and strengthening coordination among departments, agencies, and units in organizing the implementation of planning, inspection, auditing, statistics, and inventory of mineral reserves, as well as in the licensing of mineral exploration and exploitation. Review, amend, supplement, and develop regulations, rules, mechanisms, policies, and administrative procedures within the province's authority and responsibility, in accordance with central government regulations and the local situation.

Encourage research and application of advanced and modern science and technology in mineral exploration, exploitation, and processing, linked to circular economy and green economy models, adapting to climate change; protecting and minimizing environmental impacts, especially in residential areas. Continue to improve the effectiveness and efficiency of inspection, supervision, and auditing to promptly detect and strictly handle violations, and effectively prevent illegal activities in resource and mineral activities.

The Vietnam Coal and Mineral Industry Group continues to strengthen its close coordination with Quang Ninh province in implementing Resolution No. 16 in 2024 and the new resolution replacing it in the new phase. Through this, they will promptly identify shortcomings and potential risks that are predicted to negatively impact the development of the coal industry as well as Quang Ninh province, in order to jointly agree on mechanisms and measures for coordination, and to reach a consensus on timely and thorough solutions in accordance with the regulations of the Party and the laws of the State.
