The Ministry of Public Security and the Ministry of Justice recently held a signing ceremony for a cooperation program between the two ministries on providing legal assistance in criminal investigations.
Speaking at the ceremony, a representative from the Legal Aid Department (Ministry of Justice) shared the necessity of developing a coordinated program for providing legal aid in criminal investigations. This is because the current Criminal Procedure Code and the Law on the Execution of Temporary Detention and Custody contain many new provisions ensuring the right to legal aid.
In addition, the Legal Aid Law also stipulates the responsibility of the prosecuting authorities to coordinate and facilitate the access to legal aid for those entitled to it, and to enable legal aid providers to participate in the proceedings.
General To Lam, Minister of Public Security
The Legal Aid Department has collaborated with the Department of Legal Affairs and Administrative and Judicial Reform (Ministry of Public Security) to develop a coordinated program on providing legal aid in criminal investigations. This aims to enhance coordination in ensuring that those eligible for legal aid are aware of and can utilize the service promptly at the initial stage of criminal proceedings.
The basic content of the draft program includes the scope of implementation, the form of on-call duty, the personnel involved, the mechanism for receiving requests for legal aid, the duties of on-call personnel and support staff, and the responsibilities of the implementing agencies and organizations.
According to General To Lam , Minister of Public Security, the signing of the cooperation program on providing legal assistance in criminal investigations demonstrates the increasingly close and practical coordination between the two ministries in creating the most favorable conditions for those receiving legal assistance.
The early involvement of legal aid assistants in the investigation of criminal cases helps the accused and those against whom prosecution is being sought feel more secure, understand their rights and obligations, and contributes to ensuring that investigators conduct the case objectively and quickly.
Minister of Justice Le Thanh Long
Minister of Justice Le Thanh Long added that the number of legal aid cases referred to the Legal Aid Center by police investigation agencies at all levels has been increasing year by year. The Minister expressed his hope to continue receiving the attention and close cooperation of the Ministry of Public Security in guiding and directing police at all levels to coordinate with the Departments of Justice of provinces and centrally-administered cities to fully implement the tasks in this cooperation program.
The program is implemented in all state-run legal aid centers and the entire system of police investigation agencies, police agencies assigned to conduct certain investigative activities, the system of detention facilities under the People's Police, and commune, ward, and town police nationwide.
