Many projects are slow to put the land into use.
Land is a vital but limited resource; therefore, the law clearly defines the responsibilities of organizations and businesses when the State allocates or leases land for project implementation. Utilizing land for its intended purpose and on schedule is not only a legally mandated obligation but also contributes to improving resource exploitation efficiency and promoting socio-economic development.
According to Clause 8, Article 81 of the 2024 Land Law, land allocated or leased for investment projects that remains unused for 12 consecutive months from the date of handover on-site, or is delayed by more than 24 months compared to the plan stated in the project, will be considered for an extension of up to 24 months, with additional payment of land use or lease fees required. If, after the extension period, the enterprise still fails to utilize the land, the State will reclaim it without compensation. This is a strict penalty aimed at preventing land hoarding and inefficient land use.

In reality, many projects in the province are experiencing delays in implementation. A typical example is Hoa Binh Industrial Waste Treatment and Recycling Joint Stock Company. In 2010, this company was leased over 148,000 m² of land in Dong Huong village, Nham Son commune (now Dong Huong residential area, Yen Dung ward) to build a production and business facility. After receiving the land, the investor was responsible for implementing the project according to the committed schedule.
In 2019, the company was granted an amended investment registration certificate to implement a project to increase the capacity of its industrial waste treatment and scrap recycling plant. This project is significant in waste treatment, contributing to environmental protection and sustainable industrial development.
However, upon inspection, the enterprise was found to have failed to put the land into use within the stipulated timeframe, with progress lagging more than 24 months behind schedule. Many key components have not been constructed, the technical infrastructure is incomplete, and a large portion of the land remains vacant or underutilized, resulting in wasted resources and negatively impacting the local development plan.
Similarly, Thai Son Blu Limited Company (formerly Quang Lam Limited Company) leased over 42,000 m² of land since 2010 to implement a recreational and tourism service center project in Tien Phong ward. Despite numerous extensions of the deadline, the company has failed to implement the project. According to the final amended investment registration certificate, the facility should have been operational by May 2025, but to date, the land has not been utilized to its full potential.
For example, IBT Joint Stock Company, located in Dong residential area, Tan Tien ward, leased nearly 3,900 m² of land in 2019. After receiving the land, the company did not proceed with construction according to schedule, with delays exceeding 24 months. To date, the land still lacks the main components and has not been put into use as intended by the investment.
In addition to the cases mentioned above, a preliminary review by the authorities revealed that the province currently has over 70 projects that are slow to implement, have not put the land into use, or are using it inefficiently, concentrated in the communes and wards of Tien Du, Lien Bao, Dai Dong, Tan Tien, Tien Phong, etc. This prolonged situation not only wastes land resources but also results in budget losses, affecting the socio-economic development and investment environment of the province.
Resolutely reclaim the land.
According to the Department of Agriculture and Environment, the main reasons for this situation are the limited financial and implementation capacity of some investors. In addition, some projects are hampered by legal procedures and planning issues; land clearance is prolonged; and the investors of some projects lack decisiveness in organizing implementation after being allocated or leased land.

In order to improve the effectiveness of state management of land, on September 11, 2025, the Standing Committee of the Provincial Party Committee issued Directive No. 04-CT/TU on strengthening leadership in preventing and combating waste in the management and use of public assets, land, mineral resources, and investment projects.
Based on this, the Provincial People's Committee is implementing a comprehensive set of solutions to definitively address projects that are behind schedule or violate land laws. Specifically, relevant departments and agencies are tasked with reviewing and classifying each project. For projects that are still feasible to continue implementation, the province will consider extending the deadline in accordance with regulations. Projects with prolonged violations that fail to rectify will have their land revoked.
Following a review, the Provincial People's Committee has revoked over 42,000 m² of land from Thai Son Blu Limited Company in Tien Phong Ward and assigned it to the Provincial Land Fund Development Center for management. Regarding Hoa Binh Industrial Waste Treatment and Recycling Joint Stock Company, authorities have requested that the company complete its documentation for consideration of an extension as per regulations, while also closely monitoring the project's progress in the coming period. Further delays will result in legal action. Authorities have also instructed IBT Joint Stock Company to complete its documentation and submit it to the competent authority for consideration of an extension of land use rights, ensuring compliance with regulations.
In particular, the Provincial People's Committee has established an inter-agency task force to comprehensively review projects that are behind schedule. The task force is responsible for inspecting, classifying, and clarifying the causes of delays, while also proposing solutions to resolve or handle them in accordance with the law. According to Mr. Dao Quang Khai, Vice Chairman of the Provincial People's Committee, the handling of projects with delayed land use must be carried out strictly and in accordance with regulations. The province is determined to reclaim land from projects that are not implemented or have prolonged delays, preventing the situation of holding onto land that wastes resources and negatively impacts overall development.
In the coming period, the province will continue to inspect and strictly handle projects that violate regulations, ensuring compliance with the law. At the same time, it will tighten the investor selection process, improve the quality of capacity assessment, and strengthen inspection and supervision of land use from the outset.
