According to Reuters, Mary Marlowe Sommer - Judge of Santa Fe County Court in New Mexico - USA, sentenced Dave Halls to 6 months of suspended prison with unsupervised probation, a fine of $ 500, 24 hours of community service and a class on gun safety. Previously, Dave Halls had agreed to plead guilty to negligent use of a deadly weapon.

The verdict marks a new step forward for New Mexico state prosecutors in the case.

"Rust" movie set

Halyna Hutchins was killed when Alec Baldwin fired a live round from a revolver while rehearsing his scene on the set of "Rust". As assistant director and set safety coordinator, Dave Halls was responsible for ensuring safety on set.

“Dave Halls did not check every round in the gun to confirm that it was a fake and not a real bullet,” prosecutors said. Dave Halls, a veteran of the industry who has worked on more than 80 action films, was the only member of the “Rust” crew to enter into a plea agreement, approached prosecutors and was extremely cooperative.

It is unclear whether Dave Halls will testify on behalf of the prosecution at a preliminary hearing in May to consider involuntary manslaughter charges against actor Alec Baldwin and Hannah Gutierrez-Reed, who was a firearms supervisor on the set of “Rust.” Baldwin has pleaded not guilty to involuntary manslaughter, saying he relied on firearms experts Dave Halls and Hannah Gutierrez-Reed to ensure the gun was safe to use.

The incident occurred in Santa Fe, New Mexico, USA on October 21, 2021. Local police confirmed that two people were shot. Of which, female director of photography Halyna Hutchins, 42 years old, was killed; and director Joel Souza, 48 years old, was injured.

Actor Alec Baldwin was given an empty prop gun by the crew to rehearse an action scene. However, while Alec Baldwin was holding the gun to rehearse, the gun suddenly exploded, causing a tragedy.

The actor cried when telling the story to the media.

An FBI report in August 2022 concluded that the gun could not have fired unless someone pulled the trigger, meaning Alec Baldwin could still face criminal charges.

In November 2022, Alec Baldwin filed a lawsuit in the Los Angeles Superior Court against Hannah Gutierrez-Reed, the film's weapons supervisor, props supervisor Sarah Zachry, assistant director and safety coordinator David Halls, who gave the prop gun to Alec Baldwin, ammunition supplier Seth Kenney, and his Albuquerque-based PDQ Arm & Prop Company.

According to Alec Baldwin, these defendants were negligent in their work leading to the terrible tragedy on the set of "Rust". All previously denied responsibility in the incident.

In October 2022, Halyna Hutchins' family announced that they had agreed to settle their lawsuit against actor Alec Baldwin and the producers of "Rust." The producers said they wanted to restart the "Rust" film project in January 2023.

In January 2023, Alec Baldwin and Hannah Gutierrez-Reed - the weapons supervisor on the set of "Rust" - were announced to be charged with manslaughter.
