The Ministry of Education and Training has issued many new regulations on paying teachers for overtime teaching.

TPO - The Ministry of Education and Training has just announced the Draft Circular regulating the overtime pay regime for teachers in public educational institutions. The regulations are expected to be applied immediately in the 2024-2025 school year to overcome difficulties and obstacles in implementing overtime pay regimes for teachers in public educational institutions in the past.

The Ministry of Education and Training believes that, with current regulations, there are still some problems such as not being able to pay overtime wages to teachers due to conditions for receiving them. For example, preschool teachers, due to the nature of their work, actual working hours can be up to 9-10 hours; there is no basis for converting between teachers' teaching hours and administrative working hours.

The draft Circular regulating the overtime pay regime for teachers in publiceducational institutions has the following new points:

Adjustment of overtime payment conditions

The draft Circular removes the regulation on conditions for paying overtime allowances to teachers, instead only stipulating the maximum total number of teaching hours in a school year for which each educational institution is entitled to pay overtime wages. At the same time, it adds a regulation that the total number of extra teaching hours in a school year for all teachers must not be higher than the maximum total number of extra teaching hours in a school year for the educational institution.

In case there are not enough teachers to teach a subject and the teaching hours exceed the maximum number of paid hours, the head of the educational institution shall report to the management agency to make payment of extra teaching salary.

The Ministry of Education and Training has issued many new regulations on paying overtime wages for teachers in public educational institutions.

This regulation aims to remove difficulties and obstacles for educational institutions, while ensuring that teachers enjoy overtime benefits according to the provisions of the Law on Civil Servants and the Labor Code.

In addition, based on this regulation, school principals must assign tasks to teachers appropriately, ensuring fairness and minimizing the situation in an educational institution where there are teachers who teach overtime and teachers who teach short hours.

Regulations for teachers not to work overtime

Joint Circular No. 07 stipulates that the total number of extra teaching hours that are paid for extra teaching in a school year must not exceed the number of overtime hours as prescribed by law. However, the new Draft Circular stipulates in detail the total number of hours that are paid for extra teaching: For preschool teachers, it must not exceed the number of overtime hours as prescribed by law on labor; for teachers at other levels, it must not exceed 150 teaching hours.

According to the Ministry of Education and Training, this regulation ensures that it is consistent with the specific professional activities of teachers. In order to have 1 hour of direct teaching in class, teachers must have time to prepare before class and must have time after class to evaluate and classify students. The regulation also aims to ensure that teachers do not have to work too hard and have time to rest and restore their labor.

Paying extra tuition for seconded teachers

The Ministry of Education and Training has also regulated the responsibility for paying extra teaching salaries for teachers who teach in inter-school or on secondment. The extra teaching salary of teachers sent on secondment is paid by the educational institution to which the teacher is sent. The extra teaching salary of teachers sent by competent authorities to teach in inter-school is paid by the educational institution to which the teacher is sent to teach in inter-school.

In case a teacher is assigned to teach at three or more educational institutions at the same time, the teacher's overtime salary will be paid by the educational institutions where the teacher teaches at the same school, and the teacher's extra teaching hours will be divided equally among these educational institutions.

The draft also adds regulations on the timing of paying overtime wages to teachers after the end of the school year.

Teachers who retire, take sick leave, take maternity leave beyond the legal regulations, take unpaid leave, or take other leave that does not directly involve teaching are entitled to overtime pay for the actual working time. This creates a legal framework for educational institutions to pay overtime pay to teachers who retire, take sick leave, take maternity leave beyond the legal regulations, take unpaid leave, or take other leave that does not directly involve teaching.

It is worth mentioning that according to the new Draft Circular, educational institutions are allowed to apply the regulations on overtime pay according to this Circular when paying overtime pay to teachers in the 2024-2025 school year.

"If approved, the circular, when issued, will overcome difficulties and obstacles in implementing overtime pay regimes for teachers in public educational institutions in the past, creating favorable conditions for educational institutions in implementing regimes and policies for teachers," the Ministry of Education and Training affirmed.
