The Ministry of Home Affairs has just sent a document to ministries, ministerial-level agencies and agencies attached to the Government; The People's Committees of provinces and cities propose to strictly observe the Party's regulations and laws on disciplining cadres, civil servants and public employees.
In compliance with the Party's regulations and the law, on the basis of the proposal of a number of ministries, branches and localities, the Ministry of Home Affairs has submitted to the Prime Minister for consideration and decision on administrative discipline according to its competence in cases of violations that have been subject to Party discipline.
However, in the process of implementation, a number of ministries, branches and localities have been slow to request the Prime Minister to handle administrative discipline after a decision on party discipline has been issued.
On the other hand, some documents propose disciplinary action but have not yet proposed the form of discipline, the time of discipline and the time for disciplinary enforcement in accordance with the provisions of Decree No. 112/2020. This led to the delay in issuing the Prime Minister's decision on disciplinary action.
Following the direction of Deputy Prime Minister Tran Luu Quang, the Ministry of Home Affairs requested ministries, branches and localities to thoroughly and fully implement the Party's regulations and the law on disciplinary handling in cases of violations, especially to ensure the time and deadline for disciplinary action.
Accordingly, in case a decision on handling of party discipline has been issued, a decision on administrative disciplinary handling shall be promptly issued according to its competence.
If it falls under the disciplinary sanctioning competence of the Prime Minister, within 7 working days from the date of publication of the decision on party discipline, there must be a written request for administrative disciplinary handling; in which the specific form of discipline, the time of disciplinary action and the time for enforcement shall be sent to the Prime Minister, and at the same time, the Ministry of Home Affairs shall be sent to appraise and report to the Prime Minister for consideration and decision.
