In 2011, musician Zack Hemsey released the album "The Way," which included 10 tracks. He was the author and owner of the recordings on the album. In October 2017, Zack Hemsey discovered that the music video for "Touch My Heart Just a Little Bit" had been edited, using "The Way" —the title track of the album—as background music for a car accident scene involving the actors.

Claiming that Noo Phuoc Thinh illegally used and negatively impacted the integrity of the original work, Zack Hemsey filed a lawsuit, demanding that the singer cease the infringing behavior, remove the music video from all storage platforms and social media, pay damages of 850 million VND, and issue a public apology in the press.

Singer Noo Phuoc Thinh stated that he is not the owner of the music video. Specifically, in July 2017, he was invited by Mr. Le Tuan Khanh to collaborate on the project as an actor and lead singer; he has now fully fulfilled his contractual obligations and received his full remuneration. Accordingly, Mr. Le Tuan Khanh – the person who invited Noo Phuoc Thinh to participate in the project – was responsible for developing the script, hiring the director and actors, and purchasing the copyright for the song "Cham Khe Tim Anh Mot Chut Thoi" (Just Touch My Heart a Little) .

He also used the singer's image, name, and performances to exploit them on YouTube. According to Noo Phuoc Thinh, Mr. Khanh is the actual owner of the music video "Cham Khe Tim Anh Mot Chut Thoi " and the YouTube channel "Noo Phuoc Thinh".

According to the first-instance civil judgment, the panel of judges ruled against accepting all of Zack Hemsey's claims. Based on the cooperation agreement between Le Tuan Khanh and singer Noo Phuoc Thinh, the two parties agreed on the management, development, and exploitation of the YouTube channel owned by Khanh.

The judgment determined that Mr. Khanh is the owner of the music video " Chạm khẽ tim anh một chút thôi " and the YouTube channel "Noo Phước Thịnh". Noo Phước Thịnh was not the user of the recording "The Way" , and did not infringe on the plaintiff's copyright or related rights to this work or recording. Therefore, the request for singer Noo Phước Thịnh to compensate for material and emotional damages, legal fees, and issue a public apology in the press for copyright and related rights infringement is unfounded.

Noo Entertainment, the agency of singer Noo Phuoc Thinh, has publicly announced the first-instance ruling in the intellectual property dispute between him and musician Zack Hemsey. "This ruling clarifies the transparency and correctness of singer Noo Phuoc Thinh's artistic activities. Singer Noo Phuoc Thinh sincerely thanks the audience, partners, and media for their companionship and support throughout this time," the announcement stated.
