- Due to difficulties in some criteria according to regulations, in the past, the implementation of renovating depleted natural forests that are incapable of self-recovery in the province according to Resolution No. 95 dated September 20, 2022 of the Provincial Party Standing Committee on renovating production forests which are natural forests that are incapable of self-recovery to develop the forestry economy in the province in the period of 2022 - 2030 has encountered many difficulties.
The implementation of the renovation of the depleted natural forest area in the province according to Resolution No. 95 will contribute significantly to creating favorable conditions for people to develop the economy. However, in reality, to put the above resolution into practice, there are still many difficulties that need to be resolved.
Based on practice
According to statistics from the Department of Agriculture and Rural Development (DARD), the province currently has more than 602,000 hectares of forestry land; the forested land area is more than 578,000 hectares, of which the natural forest area is over 257,000 hectares. The whole province has about 3,800 families and individuals who are owners of production forests, which are depleted natural forests with no reserves, with a total area of about 20,000 hectares.

Before Resolution No. 95 was issued, people in the province still arbitrarily destroyed natural forests to plant forests. The biggest cause still came from the fact that people in some localities did not have production forests. According to statistics from the provincial forestry sector, from 2020 to 2022, on average, there were over 100 violations of forestry regulations each year in the province. Among them, there were many cases of illegal destruction of natural forests.
The most typical case is in Binh Gia district. From 2020 to 2022, the whole district had more than 120 violations of forestry regulations, of which more than 50% were illegal destruction of natural forests. According to Mr. Hoang Ngoc Duong, Head of the Binh Gia District Forest Protection Department, the district currently has more than 85,000 hectares of forest, of which more than 61,000 hectares are natural forests. The cause of the violations is that households lack land for production and do not fully understand the provisions of the law, so they arbitrarily clear trees in natural forest areas to plant other types of trees.
According to the assessment of the Provincial Forest Protection Department, the renovation to develop the forestry economy will bring high economic efficiency, estimated to reach from 100 - 250 million VND/ha with each cycle from 5 years to more than 10 years depending on the type of tree and wood. Therefore, the renovation of the area of depleted natural forests in the area not only creates conditions for people to develop the forestry economy but also contributes to significantly reducing violations of forestry regulations.
Based on the actual situation, on September 20, 2022, the Provincial Party Standing Committee issued Resolution No. 95 on renovating production forests, which are natural forests that are not capable of self-regeneration, to develop the forestry economy in the province in the period of 2022 - 2030; on November 9, 2022, the Provincial People's Committee issued Plan No. 231 on implementing Resolution No. 95, setting out specific goals for each period. Accordingly, in the period of 2023 - 2025, it is expected to renovate about 6,000 - 9,000 hectares; in the period of 2026 - 2030, it is expected to renovate about 10,000 - 15,000 hectares.
Actively deploy
After Resolution No. 95 of the Provincial Party Standing Committee and Plan No. 231 of the Provincial People's Committee were issued, from the end of 2022 to present, the Department of Agriculture and Rural Development has advised the Provincial People's Committee to issue 5 documents directing departments, branches and district People's Committees to actively implement. In addition, the Department has proactively developed and issued 33 documents on implementing the contents of the above resolution, coordinating with districts and cities to guide local authorities in implementation.
According to Mr. Nguyen Manh Tuan, Chairman of Binh Gia District People's Committee, after Resolution No. 95 was issued, on September 20, 2022, the District People's Committee issued Plan No. 68 on the implementation of Resolution No. 95; established a working group to assist the Council for the appraisal of the renovation of production forests that are natural forests that are not capable of self-recovery to develop the forestry economy in Binh Gia district in the period of 2023 - 2025. At the same time, the district directed communes and towns to develop specific plans for implementation; directed specialized agencies, especially the District Department of Agriculture and Rural Development to actively coordinate with the People's Committees of communes to propagate and disseminate this content to the people.
According to Ms. Hoang Thi Anh, Head of the Department of Agriculture and Rural Development of Binh Gia district, since implementing Resolution No. 95, the unit has coordinated with specialized departments and People's Committees of communes and towns to create propaganda bulletins through mass media for about 70,000 listeners. In addition, the units have organized about 100 propaganda meetings in the form of district-level, commune-level and village-level meetings. Thereby, disseminating Resolution No. 95 and related legal regulations to about 10,000 people (mainly forest owners).
Not only Binh Gia district, since the end of 2022, the People's Committees of districts and cities have organized over 600 conferences and meetings from district to commune level, village and hamlet meetings for about 40,000 participants. Thereby, contributing to raising awareness of people and forest owners about the provisions of the law and the contents and subjects applicable to the work of renovating depleted natural forests in the province. Thereby, many forest owners have submitted applications for forest renovation. To date, 669 applications for forest renovation from forest owners have been received by the Department of Agriculture and Rural Development of 6/11 districts and cities with a total area of renovation of more than 1,600 hectares. Of which, over 90% of the applications arose in Trang Dinh and Binh Gia districts.
Proposed solution
The number of applications for forest renovation is not small, however, after being assessed by specialized agencies, almost all of the applications do not meet the conditions for approval.
Through practical research in the two districts with the largest number of records in the province, Trang Dinh and Binh Gia, we learned that there are many reasons leading to the above situation. Accordingly, most forest owners wish to renovate forests using comprehensive reclamation measures. However, according to Circular No. 29 dated November 16, 2018 of the Ministry of Agriculture and Rural Development regulating silvicultural measures, forest reclamation must comply with regulations on reclamation by strip or by patch; comprehensive reclamation only applies to forest plots with a slope of less than 25 degrees. Meanwhile, most forests in the province have a slope of more than 25 degrees. Therefore, the measures proposed by people for reclamation do not meet the above regulations.
Mr. Hoang Van Dai - one of more than 160 forest owners applying for forest renovation in Tan Tien commune, Trang Dinh district said: His family has about 5 hectares of forest, mainly shrubs, with no value and is applying for comprehensive renovation. However, according to regulations, the family can only carry out renovation in strips or patches, so the renovation has not been possible until now.
In addition, Circular No. 29 also stipulates that the renovation must retain trees for regeneration purposes. However, the Ministry of Agriculture and Rural Development has not yet issued guidelines to determine the list of trees for regeneration purposes, so professional agencies have no basis for assessment.
In addition to the above difficulties, according to the assessment of the Department of Agriculture and Rural Development, the time of drafting Resolution No. 95 (early 2022) used forest status data published in 2021. Up to now, many areas of poor and exhausted forests that are eligible for rehabilitation have changed, so they are not eligible for implementation.
Due to the above difficulties, up to now, only 1/669 dossiers (in Van Lang district) have been appraised with an area of about 6 hectares. In addition, during the review process, 34 other dossiers were submitted by communes for approval to renovate with a total area of 34.8 hectares. However, after being informed about the regulations on renovating measures according to strips and patches, most people withdrew their dossiers. In addition, some dossiers in the appraisal process basically met all the criteria, but due to problems in determining the target trees, they have not been submitted by the appraisal council to the District People's Committee for approval.
In addition, according to the assessment of the Department of Agriculture and Rural Development, in the process of appraising the renovation applications, the appraisal councils of some districts have not really made efforts, leading to slow appraisal progress. Up to now, the appraisal progress has only reached over 90% of the total number of applications (more than 600 applications have been appraised).
According to Mr. Vu Van Thinh, Deputy Director of the Department of Agriculture and Rural Development, in order to gradually remove difficulties in implementing Resolution No. 95, the Department of Agriculture and Rural Development has been and is continuing to promote propaganda so that people can correctly and fully understand the renovation of depleted natural forests as well as related regulations. In addition, the Department advised the Provincial People's Committee to issue a list of target trees as a basis for appraising the renovation applications of forest owners. At the same time, it directed the forest rangers to coordinate propaganda, speed up the appraisal of arising applications and promptly grasp the difficulties and obstacles in implementation to propose solutions.
In addition, in order to address the wishes and desires of the majority of forest owners in choosing reclamation measures, since the beginning of May 2024, the Department of Agriculture and Rural Development has proposed that the Provincial National Assembly Delegation recommend that the Ministry of Agriculture and Rural Development review and amend Point a, Clause 2, Article 8 of Circular No. 29 on the use of complete reclamation measures for forest plots with a slope of less than 45 degrees to suit the actual terrain of mountainous provinces.
It can be seen that, with the actual development of the province's forestry economy, the issuance of Resolution No. 95 is correct, timely and in line with the expectations of many forest growers in the province. Therefore, in order for the resolution to soon come into practice, in addition to proposing the completion of related mechanisms and policies, specialized levels and sectors need to continue to pay attention, propagate and provide specific instructions so that forest owners can clearly understand and propose improvement plans that meet the provisions of the law.
