According to the Report on some major issues in receiving, explaining, and revising the draft Law on National Defense, Security, and Industrial Mobilization, there are comments from National Assembly delegates requesting additional regulations on "Combination of defense industry" to fully institutionalize Resolution No. 08-NQ/TW dated January 26.1.2022, 2030 of the Politburo on promoting the development of defense industry to XNUMX and the following years; Other opinions suggest piloting the Defense Industrial Complex model before stipulating it in the Law.
Based on the opinions of National Assembly delegates and the opinions of National Assembly Leaders, the Standing Committee of National Defense and Security agreed with the drafting agency to develop two plans. Accordingly, Option 1: Adding 1 section (Section 7 - Chapter II) regulating the "Defense Industrial Complex" including 5 articles (from Article 39 to Article 43) as in the draft Law on acquisition and revision. This regulation institutionalizes the Resolution of the 10th Party Congress on the 2021-year socio-economic development strategy from 2030 to 08 and Resolution No. XNUMX-NQ/TW. Currently, there is no legal document regulating the Defense Industrial Complex, but the methods and methods of linking and cooperating in the production of defense products have been formed for many years and are regulated in many documents. copy. With the nature of increasingly modern technical weapons and equipment, meeting the needs of protecting the Fatherland in the new situation requires the participation and association of a large number of establishments for research and production. exporting materials, components, and semi-finished products of defense products. The experiences of countries with modern defense industries all have the model of the Defense Industrial Complex.
Option 2: Assign the Government to pilot the National Defense Industrial Complex model to implement Resolution No. 08-NQ/TW of the Politburo, ensuring caution and practical testing before stipulating in the Law. This content will be prepared to be included in the Resolution of the Saturday Session of the XNUMXth National Assembly.
The Standing Committee of National Defense and Security agreed with the drafting agency of the Law project to choose option 1, with principled regulations and assigned the Government to make detailed regulations on the Defense Industrial Complex. The defense industrial complex does not form a legal entity, is not a corporation, but is defined as a system of linkage and cooperation to perform the tasks of producing defense industrial products. This plan ensures both legal basis and prudence.
A special regulatory group with a key role and position
Agreeing with option 1, National Assembly delegates emphasized that this is a very special group of regulations. The content from Article 39 to Article 43 is also stipulated in the direction of determining the principle framework of the contents, functions and tasks of defense industrial complexes; composition of the defense industrial complex; conditions, mechanisms, policies and responsibilities of the defense industrial base which is the core and nucleus of the defense industrial complex; The State's policy on the defense industrial complex aims to meet the requirements of developing the defense and security industry until 2030.
According to National Assembly Delegate Nguyen Tao (Lam Dong), the defense industry has an extremely important position, the top goal of building and developing the defense industrial complex is to research, develop and manufacture weapons and equipment. to equip the army and security; At the same time, participating in the production of civil goods to serve the task of national economic development, meeting the requirements of building and protecting the Socialist Republic of Vietnam in the new situation. Production lines can be flexible and transformed to both serve economic development needs and be able to quickly respond to defense needs during wartime. “Therefore, when stipulated in law, the budget for research and development will be increased. This is the source of new technology, has a key role and position, creating the nation's combined strength in the new era," the delegate said.
Sharing the same opinion, National Assembly Member Tran Dinh Gia (Ha Tinh) said that, in the current context, autonomy in research, manufacturing, production and products serving national defense is extremely necessary, especially for in mastering background and core technologies in the production of modern equipment to serve the task of protecting the integrity of the Fatherland. If we only develop small, separate production facilities, we cannot master advanced technologies, background technologies, and core technologies. Therefore, delegate Tran Dinh Gia affirmed that it is necessary to have policies to both master advanced technologies and develop supporting industries and key military industrial bases, in addition to That mobilizes businesses and organizations inside and outside the military to participate in supporting industries. Only then can we produce modern technical means and weapons.
To further improve regulations on this issue, National Assembly Member Huynh Thi Phuc (Ba Ria - Vung Tau) suggested that attention should be paid to appropriate policy and regulatory mechanisms along with a legal corridor for construction and development. The defense industry will be effective by continuing to review and supplement issues of development and investment in science and defense industry. This not only concretizes the Party's policies and resolutions but also aims to resolve inadequacies and problems, as well as the contents specified in relevant laws such as the State Budget Law, Bidding Law and other related laws. other laws, while this draft Law has not yet been expressed.
Besides, defense industry, security and industrial mobilization are major issues of the country related to the entire population.
