According to a report from Hai Duong province, the Dai An II residential area project (the Project) has been underway since 2011, utilizing a portion of the Dai An Industrial Park land (owned by Dai An Company) and some interspersed land areas.
However, the People's Committee of Hai Duong province and relevant departments and agencies have been slow in implementing procedures (adjusting land use plans, approving detailed plans, changing land use purposes, selecting investors, etc.), leading to Dai An Company arbitrarily investing in construction without being assigned as the project's investor as required by regulations.
To date, the People's Committee of Hai Duong province has addressed the responsibilities of relevant organizations and individuals, rectified some violations and obstacles as concluded by the Government Inspectorate , and proposed a plan for selecting an investor to implement the Project.
At the meeting, after hearing the opinions of the leaders of Hai Duong province, the Ministry of Agriculture and Environment, representatives of the Government Inspectorate, Dai An Company, etc., Deputy Prime Minister Tran Hong Ha stated that the project has been delayed from 2011 to the present due to many legal obstacles caused by the delays of the Hai Duong Provincial People's Committee and related departments and agencies (during the period 2016-2020).
Furthermore, Dai An Company violated construction and land laws by arbitrarily investing in and completing approximately 80% of the basic technical infrastructure of the Project without being officially assigned as the project's investor. However, most of this infrastructure was assessed as conforming to the subsequently approved 1/500 detailed planning and technical standards.

Deputy Prime Minister Tran Hong Ha requested Hai Duong province to definitively resolve the outstanding issues of the Dai An II residential area project in accordance with the conclusions of the Government Inspectorate, including clarifying and handling any transactions (if any) that occurred when the project did not meet the necessary conditions, and to prevent the occurrence of new violations.
The Hai Duong province needs to submit a formal, complete written report to the Prime Minister, committing to the accuracy of the information and assuming full responsibility; in particular, it must inspect, evaluate, and ensure that the adjacent Dai An Industrial Park is a green, clean industrial park that does not cause pollution or affect residential areas.
Based on this, Hai Duong province proceeded cautiously, ensuring the interests of the State and businesses, and preventing loopholes, losses, and waste, in selecting investors to implement the Dai An II residential area project, following the procedures stipulated in Resolution 171/2024/QH15 of the National Assembly and Decree 75/2024/ND-CP of the Government on piloting the implementation of commercial housing projects through agreements on land use rights or existing land use rights. These are new pilot mechanisms and policies expected to resolve legal obstacles for many real estate projects, aiming to put land resources into efficient use, solve difficulties for businesses, and avoid prolonged waste.
