Prosecution recommended for former Director of the Department of Health of Tay Ninh province.

On September 15th, the Investigation Police Department of the Ministry of Public Security completed its investigation report and recommended the prosecution of Mr. Hoa Cong Hau (former Director of the Department of Health of Tay Ninh province), Ms. Hoang Thi Thuy Nga (former Chairwoman of the Founding Board of NSJ Group), and 12 accomplices for the crimes of "Violating regulations on bidding causing serious consequences" and "Negligence causing serious consequences".

According to the investigation's conclusions, after being asked for help by Ms. Hoang Thi Thuy Nga, Mr. Hau instructed Le Thanh Lu (the defendant, former Deputy Head of the Planning and Synthesis Department, Tay Ninh Department of Health) to introduce the Siemens Healthcare 128-slice CT Scanner system to NSJ Company and approved the purchase price of 28 billion VND as requested by Ms. Nga.

Mr. Hau also instructed Mr. Lu to advise him to sign Submission No. 318/TTr-SYT dated October 9, 2017, sent to the People's Committee of Tay Ninh province, designating the purchase of the Somatom Defense AS 128-slice CT Scanner system from Siemens Healthcare, distributed by NSJ Company.

During the bidding process, Mr. Hau assigned Mr. Lu to be the Bid Evaluation Team, and simultaneously instructed a representative from the Tay Ninh Department of Health to work with Nguyen Phuoc Thien (the defendant, former General Director of Nam Saigon Consulting and Investment Joint Stock Company), the consulting unit that prepared the bidding documents. This was done to insert specific technical parameters of the Siemens Healthcare 128-slice CT Scanner system into the bidding requirements, aiming to give NSJ Company an advantage in winning the bid, thereby gaining illicit profits and causing 13 billion VND in damage to state assets.

The defendant, Hoang Thi Thuy Nga, was responsible for building the organizational structure of NSJ Company and its subsidiary companies. She assigned responsibilities to the general directors, heads of departments, and project managers across the country.

Taking advantage of her connections at various levels, Ms. Nga influenced the process to secure projects and facilitate the development of internal procedures and regulations, which served as the basis for company employees to coordinate and carry out the steps in the bidding process, from seeking approval and budgeting to organizing the bidding, contract execution, acceptance, and installation.

In Tay Ninh province, taking advantage of her relationship with Mr. Hoa Cong Hau, Ms. Nga directly instructed staff in the Customer Relations Department and the Healthcare Project Department to collude with the Tay Ninh Department of Health in preparing procurement documents and organizing bidding processes to select contractors, creating an advantage for NSJ Company to win the bid.

Furthermore, Ms. Nga instructed former NSJ Company officials and employees, namely defendants Hoang Ngoc Hong Phuc and Bach Thi Dieu Hien, to organize people to purchase bidding documents on behalf of "dummy" contractors; she also instructed former officials and employees, namely defendants Phung Thi Suong, Nong Thi Bich Suu, and Doan Thi No, to prepare bidding documents for "dummy" contractors, then assigned NSJ Company employees to submit them and participate in the bidding process at the Department of Health, creating conditions for NSJ Company to win the bid, gain illicit profits, and cause damage to state assets of 13 billion VND.
